Book excerpt: This report discusses the Department of Defense's (DoD) Theater-Wide Internal Security Services (TWISS) contracts for labor, weapons, equipment, and other essentials to augment and/or replace military security guard operations at forward operating bases and camps throughout Iraq. Altogether, DoD awarded TWISS contracts in September 2007, with a combined not-to-exceed value of $450 million, to five companies: Aegis Defence Services, Limited;1 EOD Technology, Inc.; Sabre International Security; Special Operations Consulting- Security Management Group; and Triple Canopy, Inc. The companies are among the seven largest private security service providers in Iraq. The five contractors participating in TWISS each received a $250,000 task order obligation to meet the guaranteed minimum and initiate the contract; the contractors then competed to provide security services at various locations in Iraq. Between February 2008 and March 2009, 50 task orders had been issued to the companies. This report responds to the mandate in the National Defense Authorization Act for 2008 (Public Law 110-181) that requires audits of the performance of security functions to address the manner in which contract requirements were developed and contracts or task orders were awarded, and the manner in which DoD exercised control over the performance of contractors. The TWISS contracts and subsequent task orders were awarded by the Joint Contracting Command- Iraq/Afghanistan (JCC-I/A) on behalf of Multi-National Force-Iraq (MNF-I). To provide oversight of the contracts, JCC-I/A delegated contract administration and oversight to the Defense Contract Management Agency (DCMA). The task orders set forth specific security services that are required. DCMA uses Contracting Officer Representatives (CORs) to conduct day-to-day oversight of the contractors' performance and compliance with contract requirements. CORs are selected by the installation command and report to DCMA and the contracting officer.

The English Ordnance Department, which was responsible for supplying war materials to the King, is older than the British Army. Britain was no different from any other European country in using contractors to supply its overseas expeditions. From 1000 to 1800 virtually all European armies relied on contractors to support their war fighting efforts. Only when states started to move towards total war did the supply role of contractors diminish as militaries began to become self-sufficient. While it is recognized that different types of contractors now operate in the military’s operational space, this paper focuses on those supplying support functions to the military. These functions range from catering and laundry facilities, waste management, postal services, troop welfare and recreational activities to private security companies (PSCs). PSCs have had a significant impact on the ability of logistical contractors to deliver capability to the military in theater and in the case of the US military, PSCs are increasingly being seen as an alternative to troops employed in force protection roles such as guarding military camps and protecting convoys. By contracting out of these roles, PSCs influence – although not intentionally, it must be said – the military’s strategy in theater, freeing up soldiers, for example, who can then be redeployed for combat operations. This paper is divided into four parts: the first simply defines what is meant by war fighting and identifies which military tasks fall under the war-fighting banner or outside it in the case of logistical support. The second part gives a brief account of the role of contractors in support of military operations during the Cold War, which is widely seen as a period in which militaries were self-sufficient. However, the reality was somewhat different since it was during this period that contractors began to take on roles that in the past were deemed the responsibility of the military. What appeared different during the Cold War was that the contracting out of support functions was confined to home bases and had not yet reached the front line. The third part explains why states now feel the need to turn to contractors for support in expeditionary operations, while the final part examines the socio/political, economic and technological forces driving this change. It should also be noted that this paper is concerned mainly with the UK and US militaries, for the simple reason that these forces have gone the furthest in contracting out their logistical support in the operational space.

Book excerpt: With annual obligations for goods and services totaling $1.7 billion, the Immigration and Naturalization Service (INS) is one of the largest of 23 entities coming into the Department of Homeland Security (DHS). INS's procurement organization will continue to acquire goods and services under DHS. GAO was asked to review INS's contracting processes to assess whether INS has an adequate infrastructure to manage its acquisitions and to determine whether INS is following sound contracting policies and procedures in awarding and managing individual contracts. INS does not have the basic infrastructure--including oversight, information, and an acquisition workforce--in place to ensure that its contracting activity is effective. Oversight of procurement is difficult because procurement managers are placed at a low level within the organization, and they do not have the leverage to hold employees across the agency accountable for compliance with procurement policies. Further, procurement activities are not coordinated well because INS has not made effective use of cross-functional teams--consisting of procurement, program, budget, financial, and legal representatives--throughout the acquisition process. Procurement managers are unable to make strategic decisions that would allow them to maximize spending power across the agency because INS's information systems do not provide visibility into what is being spent agencywide for goods and services and who the major vendors are. INS's acquisition workforce is struggling to manage effectively large and mission-critical procurements. Despite growth in mission requirements and the overall workforce during the past decade, the agency has not been able to attract and retain the necessary contracting staff. Further, INS lacks a strategic acquisition workforce plan to help identify the knowledge, skills, and abilities the agency needs to ensure it can meet current and future requirements. In addition, acquisition planning, competition, and contractor monitoring have been inadequate on some large contracts. The lack of adequate advanced planning for several detention center contracts and one large information technology management contract limited opportunities for full and open competition. Contractor performance monitoring has, in some cases, been inadequate to provide assurance that INS received the goods or services it paid for or that quality standards were met. GAO did not find significant or widespread compliance problems with other contract criteria we reviewed. Because INS has become a significant part of DHS and brings with it a procurement function that needs attention, it is imperative for DHS leadership to address these problems early in the development of the new department.
