Although the Habitats Directive came into force in the early 1990s, the network is not yet optimally set up and lacks coherence and connectivity. The author examines the Habitats Directive’s provisions regarding the designation of Natura 2000 and discusses possible reasons for the EU Member States’ ongoing lack of compliance with their designation duties. She reassesses the 2015 REFIT Fitness Check of the Nature Directives to look for the Member States’ reasons for not having optimally complied with their designation duties yet. She then analyses the Habitats Directive to reveal elements of non-optimal drafting in its designation provisions. Sensible law reforms that do not interfere with the general framework of the Habitats Directive and which keep in mind the relevant national, regional, and international biodiversity law and policy,as well as the relevant case law will be discussed to this end. As a result, this book presents an enhanced legal designation framework that can support Member States’ compliance with their designation obligations. The book finally goes beyond the European biodiversity legislation, also shedding light on the effects of the suggested reforms for the broader biodiversity and environmental law and policy landscape, and concludes that reforming the Habitats Directive would benefit a variety of contemporary areas of law. This book targets academics and policy-makers in the field as it provides a scholarly as well as a hands-on approach to the subject of strengthening European biodiversity law.

At the outset, I only knew that I wanted to work on interest groups and litigation in the context of the European Union. At that time, I would not have believed that I would find myself some time later touring half Western Europe to interview environmental organisations, nor that I would read French, German and Dutch court rulings on the protection of endangered species whose names were completely unknown to me. Yet I never regretted my choice of topic, and hopefully the following chapters will convince the reader that it is indeed a topic that merits our attention. I would not have been able to cope with all the pitfalls of a long research project without the strong and enduring support of my friends and colleagues. Both personally and academically, I have profited enormously from my three years as a doctoral student at the department of political science at the Institute for Advanced Studies (Institut für Höhere Studien) in Vienna, Austria. The contributors identify barriers to the adaptation of conservation management, such as the mismatch between planning reality and the decision context at site level. Short and vivid descriptions of case studies, drawn from investigation areas all over Central and Eastern Europe, illustrate both the local impacts of climate change and their consequences for future management. These focus on ecosystems most vulnerable to changes in climatic conditions, including alpine areas, wetlands, forests, lowland grasslands and coastal areas. The case studies demonstrate the application of adaptation strategies in protected areas like National Parks, Biosphere Reserves and Natural Parks, and reflect the potential benefits as well as existing obstacles. A general section provides the necessary background information on climate trends and their effects on abiotic and biotic components. Often, the parties to policy change and conservation management, including managers, land users and stakeholders, lack both expertise and incentives to undertake adaptation activities. The authors recognise that achieving the needed changes in behavior – habit – is as much a social learning process as a matter of science-based procedure. They describe the implementation of modeling, impact assessment and monitoring of climate conditions, and show how the results can support efforts to increase stakeholder involvement in local adaptation strategies. The book concludes by pointing out the need for more work to communicate the cross-sectoral nature of biodiversity protection, the value of well-informed planning in the long-term process of adaptation, the definition of acceptable change, and the motivational value of exchanging experience and examples of good practice.
