Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Mortmain This work, as supplementary to the subject of administration of charities already dealt with by the author in a separate volume, has been undertaken at the suggestion of practitioners. The scope of the book is confined to the Law of Mortmain and Charitable Uses as existing subsequently to 1888, in which year the old statutes dealing with these subjects were repealed, but, to a great extent, re-enacted, and the law consolidated, by the Mortmain and Charitable Uses Act. The great innovation effected by the Mortmain and Charitable Uses Act 1891 authorising alienation of real estate by will to charitable uses, and thereby sweeping away the mass of Case Law on the subject of gifts "savouring of the realty," has made it unnecessary, in the present work, to deal with the decisions decided under the prior enactments, it being thought that, after the lapse of fourteen years, few questions will now arise upon the construction of the Old Statutes. Book excerpt: Excerpt from Commercial Mortmain: A Study of the Trust Problem I have endeavored to set forth in the following pages in a didactic form, a fair statement of both sides of the question of trusts and I place in juxtaposition in the introductory chapter, the his tory of the English Statutes of mortmain, which undertook to prevent the accumulation of lands by corporations, to show the impossibility of checking the trend of national development by penal legis lation. Mortmain means dead-hand - the locking up of real estate by corporations - because corporations having perpetual life it was assumed that once being possessed of lands they would continue to hold them indefinitely, and thus Withdraw them from the open market. Book excerpt: Excerpt from The Law of Charitable Bequests: With an Account of the Mortmain and Charitable Uses Act, 1888 Boyle on Charities, published in 1837, is a carefully written book, covering only a small field. The book is difficult to pro cure, and I could have wished to be able to examine it more thoroughly than can be done in a general library. Tudor on Charities, of which the first edition appeared in 1854, and the second in 1862, is an excellent little book, giving a succinct account of the whole law upon the subject up to the date of its publication. Book excerpt: Excerpt from A Guide to the Laws of England Affecting Roman Catholics IN offering this Treatise to the notice of the Profession, the Author feels himself called upon to say a few words in explanation. He is far from imagining himself very competent to discharge the task he has attempted. Yet, when he considers that up to the present day there has appeared not a single work on this not unimportant sub ject, he ventures to hope that even this compilation may be found of service. It was the want under which he personally laboured of the means of informing himself upon the present state of the law relating to the Roman Catholic body in Britain and its colonies, that first led the Author to undertake, for his own benefit, those inquiries, the results of which he now presumes to lay before the public. In doing so, he is quite conscious of the many imperfections which are very likely to abound in a work of the first impression. But if he shall have succeeded in facilitating the further researches of more able and learned inquirers than himself, and of clearing their path of some of those embarrassments which he has found upon his own, the Author's success will have been quite equal to his expectations. Book excerpt: Excerpt from Military and Religious Life in the Middle Ages and at the Period of the Renaissance This transformation took place gradually and slowly, as being necessary and inevitable, by the continued and simultaneous enfranchisement of men and of land. The slave whom paganism, as it disappeared, handed over to the Christian religion, passed first from a state of servitude to a state of bondage, from bondage he rose to mortmain, and from mortmain to liberty. Under the influence of the bishops, legislation was formed upon the principles of Christian morality. In the great councils of the nation, and in the royal councils, they gave a Christian direction to the government of the country, and more than once preserved national unity from being broken up. The bishops, says Gibbon, constructed the French monarchy just as the bees construct the hive. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
