Book Synopsis Sentencing and Society by : Cyrus Tata
Download or read book Sentencing and Society written by Cyrus Tata and published by Routledge. This book was released on 2017-03-02 with total page 591 pages. Available in PDF, EPUB and Kindle. Book excerpt: Combining the latest work of leading sentencing and punishment scholars from twelve different countries, this major new international volume answers key questions in the study of sentencing and society. It presents not only a rigorous examination of the latest legal and empirical research from around the world, but also reveals the workings of sentencing within society and as a social practice. Traditionally, work in the field of sentencing has been dominated by legal and philosophical approaches. Distinctively, this volume provides a more sociological approach to sentencing: so allowing previously unanswered questions to be addressed and new questions to be opened. This extensive collection is drawn from around one third of the papers presented at the First International Conference on Sentencing and Society. Almost without exception, the chapters have been revised, cross-referenced and updated. The overall themes and findings of the international volume are set out by the opening "Introduction" and the closing "Reflections" chapters. Research findings on particular penal policy questions are balanced with an analysis of fundamental conceptual issues, making this international volume essential reading for: sentencing and punishment scholars, criminal justice policy-makers, and graduate students.

Book Synopsis Constitutional Calculus by : Jeff Suzuki
Download or read book Constitutional Calculus written by Jeff Suzuki and published by JHU Press. This book was released on 2015-03-01 with total page 295 pages. Available in PDF, EPUB and Kindle. Book excerpt: How math can make a more stable democracy: “A breath of fresh air . . . a reaffirmation that mathematics should be used more often to make general public policy.” —MAA Reviews How should we count the population of the United States? What would happen if we replaced the electoral college with a direct popular vote? What are the consequences of allowing unlimited partisan gerrymandering of congressional districts? Can six-person juries yield verdicts consistent with the needs of justice? Is it racist to stop and frisk minorities at a higher rate than non-minorities? These and other questions have long been the subject of legal and political debate and are routinely decided by lawyers, politicians, judges, and voters, mostly through an appeal to common sense and tradition. But mathematician Jeff Suzuki asserts that common sense is not so common, and traditions developed long ago in what was a mostly rural, mostly agricultural, mostly isolated nation of three million might not apply to a mostly urban, mostly industrial, mostly global nation of three hundred million. In Constitutional Calculus, Suzuki guides us through the U.S. Constitution and American history to show how mathematics reveals our flaws, finds the answers we need, and moves us closer to our ideals. From the first presidential veto to the debate over mandatory drug testing, the NSA’s surveillance program, and the fate of death row inmates, Suzuki draws us into real-world debates and then reveals how math offers a superior compass for decision-making. Relying on iconic cases, including the convictions of the Scottsboro boys, League of United Latin American Citizens v. Perry, and Floyd v. City of New York, Suzuki shows that more math can lead to better justice, greater fairness, and a more stable democracy.

Book Synopsis Gertz V. Robert Welch, Inc by : Elmer Gertz
Download or read book Gertz V. Robert Welch, Inc written by Elmer Gertz and published by SIU Press. This book was released on 1992 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Elmer Gertz recalls his long battle in what legal scholars regard as the second most important libel case in legal history: Gertz v. Robert Welch, Inc. Gertz's ordeal began in Chicago during the violent peace demonstrations of 1968. A youth, Ronald Nelson, was killed by a Chicago policeman, Richard Nuccio. Gertz represented the Nelson family in civil suits against Nuccio and the Chicago police department. After Nuccio was convicted of murder, the John Birch Society published an article in its journal, American Opinion, claiming that Nuccio was framed by Communists. Gertz was targeted as a prime Communist instigator. After reading and studying the article, Gertz filed suit against Robert Welch, Inc., charging that it had defamed him by publishing highly harmful lies impugning his reputation and patriotism. Gertz writes in detail of his landmark case, which involved two trials, two reviews in the court of appeals, and two battles in the Supreme Court. Although the case was finally decided in April 1981, when a U.S. district court jury awarded him $100,000 compensatory damages and $300,000 punitive damages, Gertz did not receive payment until May 1983, after Robert Welch, Inc., had filed two unsuccessful appeals.

Book Synopsis International Commercial Arbitration and the Arbitrator's Contract by : Emilia Onyema
Download or read book International Commercial Arbitration and the Arbitrator's Contract written by Emilia Onyema and published by Routledge. This book was released on 2010-04-05 with total page 393 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the formation, nature and effect of the arbitrators’ contract, addressing topics such as the appointment, challenge, removal and duties and rights of arbitrators, disputing parties and arbitration institutions. The arguments made in the book are based on a semi-autonomous theory of the juridical nature of international arbitration and a contractual theory of the legal nature of these relationships. From these premises, the book analyses the formation of the arbitrator’s contract in both ad hoc and institutional references. It also examines the institution’s contract with the disputing parties and its effect on the arbitrator’s contract under institutional references. The book draws from national arbitration laws and institutional rules in various jurisdictions to give a global view of the issues examined in it. The arbitrator’s contract is analysed from a global perspective of arbitral law and practice with insights from various jurisdictions in Africa, Asia, Europe, North and South America. The primary focus of the book is an analysis of the formation of the arbitrator’s contract and the terms of this contract and the institution’s contract. The primary question of the consequences (if any) of the breaches of the terms of these contracts and its impact on the exclusion or limitation of liability of arbitrators and institutions is also analysed with the conclusion that since these transactions are contractual and the terms can be categorised as in any normal contract, then normal contractual remedies can be applied to the breaches of these terms. International Commercial Arbitration and the Arbitrator’s Contract will be of great value to arbitration practitioners and researchers in arbitration. It will also be very useful to students of arbitration on the topics of arbitrators and arbitration institution.
