Book excerpt: Before the Canadian Charter of Rights and Freedoms was enacted, the provinces alone determined what the language of instruction would be in the public schools. When the Charter was proclaimed on April 17, 1982, it brough a new dimension to the Canadian educational system; the right to instruction in the minority language that is now entrenched in the Constitution. This study deals with the current situation in Canada with respect to minority-language instruction and the management of educational facilities by official-language minority groups. First, we look at the parameters within which these rights are exercised, and then we examine the current situation in each province and territory.

Available in PDF, EPUB and Kindle. Book excerpt: "Language planning, that is, the creation of a more equitable situation as regards the status and use of two or more languages, is based in Canada on the provisions of the Canadian Charter of Rights and Freedoms, proclaimed in 1982. Section 23 of the Charter spells out the minority language educational rights. Canadian citizens whose mother tongue is English or French and who reside in a linguistic minority community are entitled, thanks to the Charter, to have their children educated in the language of the minority. This study focuses on the specific school situation of minority Francophone communities. It describes the state of affairs that needs to be corrected, setting out objectives with regard to the target school population and proposing measures to attain these objectives"--Introduction, page 12.

Book Synopsis The Practice of Language Rights in Canada by : C. Michael MacMillan
Download or read book The Practice of Language Rights in Canada written by C. Michael MacMillan and published by University of Toronto Press. This book was released on 1998-01-01 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: On what grounds should language rights be accorded in Canada, and to whom? This is the central question that is addressed in C. Michael MacMillan's book The Practice of Language Rights in Canada. The issue of language rights in Canada is one that is highly debated and discussed, partly because the basic underlying principles have been a neglected dimension in the debate. MacMillan examines the normative basis of language rights in Canadian public policy and public opinion. He argues that language rights policy should be founded upon the theoretical literature of human rights. Drawing on the philosophy behind human rights, the arguments for recognizing a right to language are considered, as well as the matter of whether such rights possess the essential features of established rights. Another model that is examined is the idea that rights are a reflection of the established values, attitudes, and practices of society. This analysis reveals that there is a significant gap between what a political theory of language rights would endorse and what garners support in public opinion. MacMillan also scrutinizes the federal and provincial contexts in the development of a language rights framework. From these explorations, a case is developed for a recognition of language rights that is consistent with the logic of human rights and that corresponds roughly with developing Canadian practice. The Practice of Language Rights in Canada is a unique contribution to the current literature not only because it conceives of language rights as a human right but also because it frames the whole debate about language rights in Canada as a question of values and entitlements.
Book Synopsis Constraining the Court by : James B. Kelly
Download or read book Constraining the Court written by James B. Kelly and published by UBC Press. This book was released on 2024-05-01 with total page 446 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the Supreme Court of Canada makes a decision that invalidates a statute, it creates a constitutional moment. But does that have a direct and observable impact on public policy? Constraining the Court explores what happens when a statute involving a significant public policy issue – French language rights in Quebec, supervised consumption sites, abortion, or medical assistance in dying – is declared unconstitutional. James B. Kelly examines the conditions under which Parliament or provincial/territorial legislatures attempt to contain the policy impact of judicial invalidation and engage in non-compliance without invoking the notwithstanding clause. He considers the importance of the issue, the unpopularity of a judicial decision, the limited reach of a negative rights instrument such as the Charter, the context of federalism, and the mixture of public and private action behind any legislative response. While the Supreme Court’s importance cannot be denied, this rigorous analysis convincingly concludes that a judicial decision does not necessarily determine a policy outcome.
