Book excerpt: Excerpt from California Mining Statutes Annotated The Bureau of Mines since its establishment has been collecting and publishing the laws relating to mining. The purpose of such publication is to point out the laws and regulations best adapted to increase safety and efficiency in the mineral industry of the United States and to aid legislative bodies in framing uniform mining laws. In 1915 the bureau published, in two volumes, Bulletin 94, United States Mining Statutes Annotated. That bulletin includes every section of the United States Revised Statutes and every statute enacted by Congress relating. To mines and mining. Fol lowing each section and statute, abstracts of decisions of all courts and executive officers construing such sections or statutes were collected and arranged with appropriate title lines and headings in logical order. The bulletin thus shows the status of every Federal mining law by pointing out the defects and uncertainties that were eliminated by the courts and the aid of the courts in the practical application of the mining statutes. The bulletin was published in the hope that it would serve as a guide in the location of claims and in the determination of mining rights and assist the miner in adopting measures that would insure greater safety and efficiency in mining operations. The purpose of the bureau is to follow Bulletin 94 with others that will contain complete collections of the mining statutes of the sev eral States with appropriate and explanatory annotations consist ing of abstracts of the decisions of the State courts, construing and otherwise illuminating such State statutes. These State bulletins will be published successively, either as individual State bulletins or by groups of States, with a view to uniformity in size, and all in style and manner similar to Bulletin 94. The magnitude of the work and the time necessarily involved in collecting the statutes and abstracting the decisions prevent the work being issued as a single publication. The plan adopted will result in giving preference to some States, but as a major part of all of the preparation of the work has been performed, the successive volumes will follow without great delay. Book excerpt: Excerpt from Wilson's Mining Laws: United States, Arizona, California, Nevada and Utah; Annotated, With Forms and Corporation Laws of Arizona; Revised to July 1, 1909 All mineral lands are open to occupation and purchase by any citizen, or he who has declared his intention to become a citizen of the United States. A mining claim located since May 10, 1872, shall not exceed fifteen hundred feet in length along the vein or lode and three hundred feet on each side of the middle of the vein at the surface. The locator of a mining claim has the exclusive right of possession and enjoyment of all of the surface of his claim and of all veins, lodes or ledges throughout their entire depth, the top or apex of which lies inside his surface lines extended vertically downwards. The owner of a mining claim may follow his ledge should its dip carry him beyond his side lines extended vertically down, so long as he does not trespass on the surface of another claim; but in no case can he go beyond his end lines, which must in all cases be parallel. No lode claim can be recorded until a vein or lode has been discovered thereon. Where two claims cross each other the prior location is entitled to all the ore or mineral within the space of intersection, but the subsequent location has a right of way through the space of intersection for the working of the mine, and where two or more veins unite the oldest location takes the vein below the point of union, including all the space of intersection. A Patent can be obtained on a mining claim after $500 has been expended thereon for development or improvement, upon its being surveyed by a United States mineral surveyor, and by the payment of $5 per acre for the land to the United States Government. To Hold An Unpatented Mining Claim, not less than $100 worth of labor shall be performed or improvements made thereon each year, subject to the local laws of the State or rules of the mining district. Where several claims are held in common and are contiguous, the whole expenditure may be made on any one claim. The period within which this work is required to be done begins on the first day of January of the year succeeding the year of location. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from United States Mineral Lands: Laws Governing Their Occupancy and Disposal The motive underlying the earliest congressional legislation touch in the public mineral lands was to secure a revenue therefrom. To this end the system of leasing the lead and copper mines was adopted in 1807, with its attendant agencies, accountings, etc. After a trial of nearly forty years the system was pronounced a failure, and in 1846 the mines were offered at sale, with a preference right in those who had leases or were in the occupation of the mines. When the gold mines of California were discovered, and the varied mineral wealth of the Pacific coast was brought to the attention of Congress, several revenue bills were introduced, at different times, and earnestly debated. But the notorious failure of the lease system in the Mississippi Valley, and the difficulties in the way of securing a revenue otherwise, gave success to the friends of free mining in 1866. Except in a few states, the object of congressional legislation, since 1866, has been to prevent the disposal of mineral lands to states and railroads, or in large quantities to individuals. Exploration of hidden mines is encouraged, and no efforts are used to compel miners to ex pend money in securing government title. The mining law of May 10, 1872, is essentially a poor man's law, and has been the source of incalculable wealth to the country, and indirectly of vast revenue to the government. Book excerpt: Excerpt from Handbook on American Mining Law The title American Mining Law has been chosen because of its simplicity and because the law chiefly dealt with, while it affects only a comparatively small part of the United States and its possessions, is so national in its character as deservedly to be spoken of by all writers on the subject as American Mining Law. In the notes the cases which for one reason or another are sug gested as best for students to consult are printed in large type. As is true of other Hornbooks, an exhaustive citation of cases has not been attempted, but the endeavor has been to give a comprehensive, well proportioned, and up-to-date treatment of the subject.
