Book excerpt: The Detailed Assessment report on Mexico's implementation of the International Organization of Securities Commissions Objectives and Principles of Securities Regulation is analyzed. The Mexican securities market is dominated by daily trading in short-term government debt securities, primarily through repo transactions among banks, brokers, institutions, and private investors. The 2001 Financial Sector Assessment Program noted significant structural issues in the Mexican repo market, and recommended government action to create a standard master agreement for repo transactions.

Book excerpt: A detailed assessment on the observance of Mexico’s compliance with International Organization of Securities Commissions objectives and principles of securities regulation is presented. The regimes governing the regulation of issuers, collective investment schemes, and secondary markets, and with respect to cooperation and information sharing, are extensive. The most significant issues regarding full implementation of the Principles fall under the Regulator Principles. Much of the activity on the Bolsa Mexicana de Valores comes from computer-driven program trading orders that are placed to take advantage of price asymmetries between markets.

Book excerpt: As the supervisor of the securities markets in Mexico, the National Banking and Securities Commission (Comision Nacional Bancaria y de Valores, CNBV) has developed a robust supervisory framework that exhibits high levels of implementation of the International Organization of Securities Commissions Objectives and Principles of Securities Regulation (IOSCO Principles) in many areas. The assessment was conducted during the International Monetary Fund (IMF) and World Bank Financial Sector Assessment Program (FSAP) mission to Mexico during the period September 7 to September 21, 2011. The assessment was carried out using the 2003 IOSCO methodology for assessing implementation of the IOSCO Principles. The most significant issues regarding full implementation of the Principles fall under the regulator principles. These issues flow from two sources. First, there is no specific statute governing derivatives (whether exchange traded or over-the-counter (OTC)), nor any other express legislative provisions that govern the regulation of that growing market. Second, there are significant weaknesses in the protections afforded members of the Board of Governors and staff and with the resources of the commission that lead to concerns about its independence and ability to carry out its mandate fully. This report gives summary of discussions on CNBV acceptance to allow the informal assessment of the status of implementation of the newly added Principles, using the guidance provided in the draft revised assessment methodology as issued in May 2011.

Book excerpt: This assessment of the implementation of the Basel Core Principles for effective banking supervision (BCPs) by the National Banking and Securities Commission (CNBV) is part of the Financial Sector Assessment Program (FSAP) undertaken by the International Monetary Fund (IMF) and the World Bank (WB). The assessment was performed during two missions between March 22 and April 4 and between June 21 and July 4, 2022, reflecting the regulatory and supervisory framework in place at the time of the completion of the assessment. It is not intended to represent an analysis of the state of the banking sector or crisis management framework, which are addressed in other parts of the FSAP.

Major improvements in compliance with the Basel Core Principles for Effective Banking Supervision and the implementation of International Organization of Securities Commission Principles and Objectives of Securities Regulation have been taken up. Significant progress regarding the banking safety net and evaluation of antimoney laundering practices in Mexico are under way. The key remaining challenges are to further entrench stability and to promote wider and more efficient private sector access to financing.

There has been a significant modernization of the regulatory framework, improvement of interagency coordination, and significant steps have been taken toward consolidated supervision. Book excerpt: State ownership in financial intermediation in Mexico has continued to be significant in qualitative as well as quantitative terms, with about 20-25 percent per cent of the total credit of the banking system provided by development banks (DBs) and funds during the last five years. The importance of government ownership in financial intermediation is not only quantitative, but qualitative, with influence on key sectors in the Mexican economic development. The 2001 joint World Bank- International Monetary Fund (IMF) Financial Sector Assessment Program (FSAP) that took place in 2001 identified a number of problems related to the operation of DBs in Mexico. Some DBs had unclear mandates or did not live up to their mandates with their activities overlapping among themselves or with the activities of commercial banks. Some of them were performing quasi-fiscal activities outside the scope of the budget process, and all of them were loss making even after several rounds of recapitalization. Their operation was often inefficient with high costs, too many employees, and weak internal controls. Fiscal subsidies involved in their operations were not well targeted and were channeled in a non-transparent manner. After the 2001 FSAP assessment the authorities started a reform effort addressing some of the problems mentioned above through legal reforms and tighter monitoring.

Book excerpt: This paper presents a Detailed Assessment of Mexico's compliance with the Basel Core Principles for Effective Banking Supervision and Transparency of Banking Supervision. Fiscal consolidation reduced the gross public debt-to-GDP ratio to below 50 percent, providing the foundations for a monetary policy able to bring inflation down to less than 4 percent, in the context of a floating exchange rate. These improvements have contributed to Mexico's achievement of investment-grade rating, uninterrupted access to capital at low cost, and resilience to shocks, such as the Russian crisis.
