Book excerpt: The Constitutionalization of Human Rights Law analyses how lawyers representing refugees use human rights provisions in national constitutions to close the gap between the Law and it's implementation. Focusing on five countries (Colombia, Mexico, South Africa, Uganda, the United States) the book examines how lawyers adapt creatively to social, political, and legal contexts. Many refugee-receiving states openly reject or passively ignore their obligation under international law to protect refugees. For this reason, cause lawyers (those who use the law to empower others) have turned to constitutionalized human rights law. While many countries likely included such provisions in their constitutions without intending to fulfil their commitments, cause lawyers have seized on them as a more enforceable means of rights protection. This book theorizes a continuum of ever-more ambitious methods through which cause lawyers use constitutionalized human rights law to benefit refugees. Lawyers use different tools as they move along this continuum, including strategic litigation, training governmental officials in the applicable law, and various forms of informal advocacy. It makes important contributions to three strands of socio-legal literature. As to the effectiveness of human rights treaties, it provides qualitative evidence of how such treaties achieve greater significance when incorporated into national constitutions. As to refugee law, it analyses how international protections for refugees become stronger when domestic lawyers enforce them through national constitutions. And as to cause lawyering, it shows how refugee lawyers use constitutionalized human rights law to protect their clients.

This globally agreed vision is part of a trend in international policy toward good urban governance, and now awaits implementation. Fourteen original contributions collectively examine how this global vision has been developed on a conceptual level, how it plays out in various areas of (global) urban governance and how it is implemented in varying local contexts. The overarching hypothesis presented herein is that SDG 11 proves that local governance is recognised as an autonomous yet interrelated part of the global pursuit of sustainable development. The volume analyses three core questions: How have the normative ideals set forth in SDG 11 been developed? What are the meanings of the four sub-goals of SDG 11 and how do these relate to each other? What does SDG 11 imply for urban law and governance in the domestic context and how are local processes of urban governance internationalised? The Globalisation of Urban Governance makes an important scholarly contribution by linking the narrative on globalisation of good urban governance in various social sciences with legal discourse. Book excerpt: 2023 Best Book in the Humanities, Latin American Studies Association Mexico Section Challenging conventional narratives of Mexican history, this book establishes race-making as a central instrument for the repression of social upheaval in nineteenth-century Mexico rather than a relic of the colonial-era caste system. Many scholars assert that Mexico’s complex racial hierarchy, inherited from Spanish colonialism, became obsolete by the turn of the nineteenth century as class-based distinctions became more prominent and a largely mestizo population emerged. But the residues of the colonial caste system did not simply dissolve after Mexico gained independence. Rather, Ana Sabau argues, ever-present fears of racial uprising among elites and authorities led to persistent governmental techniques and ideologies designed to separate and control people based on their perceived racial status, as well as to the implementation of projects for development in fringe areas of the country. Riot and Rebellion in Mexico traces this race-based narrative through three historical flashpoints: the Bajío riots, the Haitian Revolution, and the Yucatan’s caste war. Sabau shows how rebellions were treated as racially motivated events rather than political acts and how the racialization of popular and indigenous sectors coincided with the construction of “whiteness” in Mexico. Drawing on diverse primary sources, Sabau demonstrates how the race war paradigm was mobilized in foreign and domestic affairs and reveals the foundations of a racial state and racially stratified society that persist today.
