Book excerpt: Drawing on conceptual debates in transitional justice and critical archival studies, as well as empirical cases from various countries around the world, the contributions in this book critically examine how archives are produced by and used in transitional justice processes such as tribunals, truth commissions and remembrance processes. This edited volume provides conceptual critiques of the transitional justice paradigm and innovations in providing a new lens on archival practices in transitional justice. In doing so it offers in-depth analyses of the relationship between archives and transitional justice in France, Colombia, Rwanda, South Africa and Northern-Ireland; it highlights truth commission and (international) court archives as much as personal collections and oral histories. The authors bring critical archival studies into dialogue with transitional justice discourses to highlight the activism and emancipatory potential but also the possibilities of injustices inherent in archives and archival practice. Crucially, the book goes beyond merely highlighting the evidentiary value of archives by linking them to a multitude of transitional justice processes, goals and ideals, including remembrance processes, witnessing, reconciliation, non-recurrence, and various struggles against injustices and prevalent violence. Book excerpt: In a consolidated democracy, amnesties and pardons do not sit well with equality and a separation of powers; however, these measures have proved useful in extreme circumstances, such as transitions from dictatorships to democracies, as has occurred in Greece, Portugal and Spain. Focusing on Spain, this book analyses the country's transition, from the antecedents from 1936 up to the present, within a comparative European context. The amnesties granted in Greece, Portugal and Spain saw the release of political prisoners, but in Spain amnesty was also granted to those responsible for the grave violations of human rights which had been committed for 40 years. The first two decades of the democracy saw copious normative measures that sought to equate the rights of all those who had benefitted from the amnesty and who had suffered or had been damaged by the civil war. But, beyond the material benefits that accompanied it, this amnesty led to a sort of wilful amnesia which forbade questioning the legacy of Francoism. In this respect, Spain offers a useful lesson insofar as support for a blanket amnesty – rather than the use of other solutions within a transitional justice framework, such as purges, mechanisms to bring the dictatorship to trial for crimes against humanity, or truth commissions – can be traced to a relative weakness of democracy, and a society characterised by the fear of a return to political violence. This lesson, moreover, is framed here against the background of the evolution of amnesties throughout the twentieth century, and in the context of international law. Crucially, then, this analysis of what is now a global reference point for comparative studies of amnesties, provides new insights into the complex relationship between democracy and the varying mechanisms of transitional justice.

Beginning with his analysis of acts of knowledge common to all men, through the peculiar transformation of the rational powers undergone in the «dark night, » this study traces San Juan's examination of the mystic's knowledge in and through God. The sixteenth-century Spanish thinker stresses that conditionality is a fundamental character of all human knowledge, and brings to light a complex movement of contiguity between one and another mode of cognitive activity. Also discussed is the communication, through the instruments of prose and poetry, of the mystic's supereminent and therefore ineffable experience of knowledge and love. Relying upon Juan de la Cruz's own texts, it is shown how a relative communication can be effected despite the barriers separating mystical from ordinary cognition. The exploration highlights how San Juan turns for poetic symbols to the analogia entis, while at once basing his symbolism upon mysterious correlations between mystical, immediate cognition and ordinary acts of intellection mediated through sensation.

Book excerpt: This book is formed by various chapters studying the manner in which conflicts, changes and ideologies appear in contemporary Hispanic discourses. The contributions analyze a wide variety of topics related to the manner in which ideological and epistemological changes of the 19th, 20th and 21st centuries are reflected in, and shape, Spanish language, literature, and other cultural expressions in both Spain and Latin America. The 19th century was conducive to various movements of independence, while, in Europe, radical changes of different types and in all contexts of life and knowledge occurred. Language was certainly affected by these changes resulting in new terminology and discourse strategies. Likewise, new schools of thought such as idealism, dialectic materialism, nihilism, and nationalism, among others, were established, in addition to new literary movements such as romanticism, evocative of (r)evolution, individualism and realism, inspired by the social effects of capitalism. Scientific and technological advances continued throughout the 20th century, when the women’s liberation movement consolidated. The notion of globalization also appears, simultaneously to various crises, despotism, wars, genocide, social exclusion and unemployment. Together, these trends give rise to a vindicating discourse that reaches large audiences via television. The classic rhetoric undergoes some changes given the explicit suasion and the absence of delusion provided by other means of communication. The 21st century is defined by the flood of information and the overpowering presence of mass communication; so much so, that the technological impact is clear in all realms of life. From the linguistic viewpoint, the appearance of anglicisms and technicalities mirrors the impact of post-modernity. There is now a need to give coherence to a national discourse that both grasps the past and adapts itself to the new available resources with the purpose of conveying an effective and attractive message to a very large audience. Discourse is swift, since society does not seem to have time to think, but instead seeks to maintain interest in a world filled with stimuli that, in turn, change constantly. Emphasis has been switched to a search for historical images and moments that presumably explain present and future events. It is also significant that all this restlessness is discussed and explained via new means such as the world-wide-web. The change in communication habits (e-mail, chats, forums, SMS) and tools (computers, mobile phones) that was initiated in the 20th century has had a net effect on the directness and swiftness of language.
