While the first volume ("WTO - World Economic Order, World Trade Law") serves as a nutshell-type introduction to the WTO, the remaining six volumes focus on specific aspects of WTO law. The second volume ("WTO - Institutions and Dispute Settlement") brings together the WTO institutional fundamentals and the whole dispute settlement. The third volume ("WTO - Technical Barriers and SPS Measures") deals with the most controversial provisions on technical standards, protection of health and environment. The fourth volume ("WTO - Trade Remedies") is devoted to the very specific area of antidumping, subsidies and safeguards. The fifth volume ("WTO - Trade in Goods") comments on the substantial trade in good rules of the GATT/WTO. Eventually, the sixth and seventh volume ("WTO - Trade in Services" and "WTO - Trade-Related Aspects of Intellectual Property Rights") deal with intellectual property rights and trade in services rules respectively.

Download or read book WTO written by Rüdiger Wolfrum and published by BRILL. This book was released on 2008 with total page 1005 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the decade since the establishment of the WTO, the great majority of disputes between member states resolved and decided through the dispute settlement system of the WTO arose in the field of trade remedies law, a fact which clearly shows the high demand by the trade community for the rule of law in this area. Responsive to such needs, the fourth volume encompasses the whole range of trade remedies regulation under the auspices of the WTO in the respective articles of the General Agreement on Tariffs and Trade (GATT) and the related multilateral agreements on trade in goods, i.e., Articles VI, XII, XIX GATT 1994; the Understanding on the Balance-of-Payments; the Agreement on Implementation of Article VI GATT 1994 (Anti-Dumping Agreement); the Agreement on Subsidies and Countervailing Duties; and the Agreement on Safeguards. Leading practitioners and scholars have gathered to provide an invaluable insight and easy access to the law on trade remedies in an article-by-article commentary approach. As such, it will be an essential work not only for trade remedies practitioners but to persons interested in trade remedies be they scholars, academics, international and domestic lawyers, political scientists and economists, or NGO representatives.

Book Synopsis Non-Discrimination in International Trade in Services by : Nicolas F. Diebold
Download or read book Non-Discrimination in International Trade in Services written by Nicolas F. Diebold and published by Cambridge University Press. This book was released on 2010-10-21 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The principle of non-discrimination is fundamental to the regulation of international trade in goods and services. In the context of trade in goods, the concept of 'like products' has become a key element of the legal analysis of whether a trade obstacle violates GATT non-discrimination obligations. The equivalent concept of 'like services and service suppliers' in GATS rules on non-discrimination has received little attention in WTO jurisprudence. In light of the remaining uncertainties, Nicolas Diebold analyses the legal problems of the GATS 'like services and services suppliers' concept using a contextual and comparative methodology. The 'likeness' element is not analysed in isolation, but in context with 'less favourable treatment' and regulatory purpose as additional elements of non-discrimination. The book also explores how far theories from non-discrimination rules in GATT, NAFTA, BITs and EC as well as market definition theories from competition law may be applied to 'likeness' in GATS.

Book Synopsis Sustainability Standards and Global Governance by : Archna Negi
Download or read book Sustainability Standards and Global Governance written by Archna Negi and published by Springer Nature. This book was released on 2020-07-02 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access book focuses on the issue of sustainability standards from the perspective of both global governance frameworks and emerging economies. It stems from the recognition that the accelerated pace of economic globalization has generated production and consumption patterns that are generating sustainability concerns. Sustainability standards (and regulations) are increasingly being used in a bid to make global consumption and production more sustainable. Given the dense inter-connectedness of economic affairs globally, the use of sustainability standards has become a concern of global governance, who face the challenge of achieving a balance between the use of standards for genuine sustainability objectives, and not allowing them to turn into instruments of protectionism or coercion. The emerging economies, given their increasing engagement with the global economy, are most impacted by the use of sustainability standards. The emphasis of ‘emerging economies’ in this book is retained both by using case studies from these economies and by collating perceptions and assessments of those located in these economies. The case studies included span sectors such as palm oil, forestry, food quality, vehicular emissions and water standards, and address the problems unique to the emerging economies, including capacity building for compliance with standards, adapting international standards in domestic contexts and addressing the exclusion of small and medium enterprises etc. Complex interfaces and dynamics of a global nature are not limited to the thematic of this book but also extend to the process through which it was written. This book brings together insights from developed as well as emerging economies (Germany, India, Mexico, Brazil, Indonesia, Pakistan, Mexico and China). It also brings together scholars and practitioners to jointly ponder upon the conceptual aspects of the global frameworks for sustainability standards. This book is a very useful resource for researchers and practitioners alike, and provides valuable insights for policy makers as well.
