Book excerpt: The maritime domain of the East African Community (EAC) is affected by a number of maritime security threats, including piracy, armed robbery against ships and an ongoing maritime border dispute between Kenya and Somalia. Neither the EAC nor its member States have long-term and holistic maritime security policies. Maritime security is dealt with in an ad-hoc, case-by-case manner, mainly by individual States. This study investigates why the EAC is not taking a leading role in regional maritime security governance. The study has found that the lack of regional maritime security policies, more importantly maritime security strategy, and the absence of a maritime institutional framework at the Community level, appear to be major setbacks to regional maritime security efforts. Additionally, the EAC depends on its member States, inter-regional and international maritime security programmes which currently offer a significant boost to EAC maritime security governance. Nonetheless, an EAC maritime security strategy would formalise and customise all of these strategies to match with regional maritime security needs. Moreover, it would provide a forum for communication and cooperation among maritime stakeholders.

Book excerpt: The roles of the flag state in maritime security have recently been increasing due to the escalation of maritime security threats caused by non-state actors such as piracy, armed robbery against ships, illegal fishing, and marine environment degradation. The nexus between maritime security and flag states is very strong. This is because flag states have exclusive jurisdiction over ships flying their flags and ships are the primary tool used in all non-state maritime security threats. This study investigates the possibility of the East African Community (EAC) utilising its flag states to cover up the existing maritime safety and security governance gap in the region. While that could be possible, the EAC lacks the necessary legal and institutional frameworks to do so. The study intends to encourage the EAC Secretariat and the politicians among the EAC member states on the importance of aligning civilian institutions such as maritime authorities with other maritime law enforcement agencies against regional maritime security threats.

The Indian Ocean region, particularly the East African region does not have its own maritime policy or strategy, despite the acknowledged importance of this component of any national or regional economy. Given the unique needs of its populace, priorities and requirements of the various states, the East African part of the Indian Ocean therefore needs to develop a maritime strategy to promote economic development for its people through improved maritime security, leading to improved global competitiveness for its goods and services. To achieve the desired peace and a stable environment, cooperation and adoption of a holistic maritime legislation is mandatory which, in turn, would strengthen the maritime institutions which are crucial for a maritime strategy. This combination of strengthened and coherent legislation, institutions and cooperation would enhance the policing of, and prosecution for, illegal acts, eg piracy, terrorism, trafficking and the dumping of waste materials; it would better regulate the fishing industry; ensure pollution will be policed; countering of smuggling and illicit trade; transnational or cross-border crime would be better monitored and reduced; and further, the safe navigation of shipping guaranteed. This will eventually translate to a peaceful, a more secure and stable Indian ocean region. Thus the required good order at sea should be viewed as a function of how states should exercise their jurisdiction on maritime issues for sustainable peace and development.

Africa possesses 48,000 kilometers of coastline, comprising 38 out of 54 of the continent’s states and several strategic choke points for international shipping, such as the Suez Canal, the Gulf of Aden and the Cape of Good Hope. Nevertheless, post-colonial Africa’s small navies and their relations with the navies of external powers have not received much scholarly attention. Focusing on Sub-Saharan Africa, this collection attempts to address this neglect and stimulate further research by offering original chapters related to historical and contemporary themes around Africa’s navies. The historical chapters cover the origin of the Tanzanian, Ethiopian, Nigerian and Ghana navies during the era of decolonization and the Cold War, the asymmetrical naval campaign fought during the Nigerian Civil War (1967-70), and the activities of the Soviet Navy in supporting African states and movements fighting lingering colonialism and white supremacy during the 1970s and 1980s. Focusing on the contemporary situation, other chapters discuss the engagement of the Indian Navy with Africa, the potential role of the Angolan and Mozambican navies in the Southern African Development Community (SADC), the transformation and development of the post-apartheid South African Navy, and the challenges and capabilities of African navies in the early twenty-first century.
