They have mounted what amounts to the most substantial non-state threat to the security of international shipping for half a century and perhaps longer. Piracy outbreaks have also occurred in Southeast Asia and West Africa. In each case the international community has responded differently. What lessons can be learned from three different approaches and is it possible to distill lessons of international best practice that can be applied in the Gulf of Aden and the northern Arabian Sea? This paper will examine how and why these three piracy outbreaks arose. It will describe in particular why the threat off Somalia grew so rapidly, why it declined and why the elements that made it successful remain in place. It will examine the responses of the international community, asking whether or not the response off Somalia might have been more effective if it had benefitted from stronger international backing and more coherent coordination. It will make the point that maritime security – the prevention and suppression of disorder at sea – must address many more issues than piracy as the theft of fish and the movement of drugs; weapons and people can often present greater risks. It will build on this point by looking at maritime security developments drawn from all three regions that may be employed advantageously in the Gulf of Aden and Arabian Sea, before circling back to look at the fundamental problem, which is one of landward security and asking what initiatives have been taken to address this in Somalia and which ones appear to be yielding results. Finally, it will examine whether the way forward does lie with a unified global initiative, or if steps are better taken regionally calling upon extra-regional support as necessary.

In its Strategy on the Gulf of Guinea, the European Union highlights the threats and risks posed to these coastal states, as well as the connections to Europe as an export market for fishery products and home region of many fishing vessels. Until now, maritime security strategies for West Africa have prioritized the issues of human trafficking, smuggling of migrants, and piracy. In future, however, there should be a stronger focus on the threats posed by illegal fishing, especially when providing advice, training and equipment assistance to improve surveillance and monitoring of West African waters. The outbreak of Somali piracy that started in 2008 has prompted a similar revolution in maritime security. Private security companies began operating armed escort vessels to protect merchant shipping against pirates off the Horn of Africa. Private Anti-Piracy Navies is intended to provide a contextualized understanding of the historical origins, current state, and future prospects of this fast-changing sector. Centuries ago, the British East India Company used a private navy against piracy in the same waters with much success. Yet since then, international law has evolved to more tightly regulate the use of force by civilians, and to afford greater protections to suspected pirates. Thus, the development of what are in effect private warships has presented numerous legal and regulatory problems. How can the companies that operate these vessels be effectively licensed? Under what circumstances should they be allowed to use lethal force? This book explains how regulators in industry and government have attempted to answer such questions, and highlights the remaining areas of uncertainty. It also addresses the economic factors that drive the struggle between pirates and anti-piracy forces. Of equal concern are operational considerations such as defensive tactics, logistics, and rules of engagement. Security companies must carefully balance rights concerns against the need to defend ships effectively. Partly due to the contribution of private security, piracy in the Indian Ocean has dropped significantly over the past two years, leading to widespread overconfidence. Governments under severe budget pressure may withdraw their naval task forces from the region prematurely, leading to a resurgence of Somali piracy. At the same time, pirates are wreaking havoc in the Gulf of Guinea off West Africa. Many of these strategies are already underway in West Africa, where the United States government in particular has undertaken a broadly holistic approach to maritime security. The security and political situation in Somalia has so been far less conducive to a land-based approach: but it is certainly within the US interest to explore development- and governance-based counter-piracy initiatives as circumstances allow. Unless the international community becomes willing to invest in a land-based solution to Somalia's dire political, economic, and humanitarian distress, the plague of Somali piracy will continue.
