Book excerpt: This report discusses the findings of a nationwide study on the use of private prisons in the United States. The number of these prisons grew enormously between 1987 and 1998, with proponents suggesting that allowing facilities to be operated by the private sector could result in cost reductions of 20%. The study examined the historical factors that gave rise to the higher incarceration rates, fueling the privatization movement, and the role played by the private sector in the prison system. It outlines the arguments, both in support of and opposition to, privatized prisons, reviews current literature on the subject, and examines issues that will have an impact on future privatizations. The report concludes that, rather than the projected 20-percent savings, the average saving from privatization was only about 1 percent, and most of that was achieved through lower labor costs. Nevertheless, there were indications that the mere prospect of privatization had a positive effect on prison administration, making it more responsive to reform.

Available in PDF, EPUB and Kindle. Book excerpt: Will help improve jail operations by improving staffing practices. This workbook is a cornerstone of training and technical assistance activities related to jail staffing conducted by the U.S. Dept of Justice. Many legitimate methods can be used to conduct a jail staffing analysis. The first edition of this workbook presented a new methodology in an attempt to allow both the expert and the novice equal opportunities for success. It encouraged more jails to implement comprehensive staffing analysis, which have now become standard practice in many jurisdictions. This workbook simplifies the jail staffing analysis and allocation process, clarifies terms, and incorporates the experience of the field in the 12 years since the first edition was published. Book excerpt: Until recently, it has been assumed that suicide, although a problem for jail inmates as they face the initial crisis of incarceration, is not a significant problem for inmates who advance to prison to serve out their sentences. This monograph was produced to fill a critical void in the knowledge base about prison suicide. In addition to a through review of the literature and of national and state standards for prevention, it offers the most recent national data on the incidence and rate of prison suicide, effective prevention programs, and discussion of liability issues. Book excerpt: NCCHC's Mental Health Standards parallel its Standards for Health Services in format and substance, and likewise cover the general areas of care and treatment, clinical records, administration, personnel and legal issues. The difference is that they make more explicit what the standards require for adequate delivery of mental health services. Together, these tools can help facilities determine proper levels of care, organize systems more effectively and efficiently, and demonstrate that constitutional requirements are being met.

Book excerpt: Developed by leaders in the fields of health, law and corrections, NCCHC's nationally recognized Standards lay the foundation for constitutionally acceptable health services systems and can help prisons to improve health services delivery. The Standards address nine general areas: health care services and support, patient care and treatment, special needs and services, governance and administration, personnel and training, safety, health records, health promotion and medical-legal issues. The manual provides clear compliance indicators that define expected outcomes and aid in self-assessment, guidelines for facilities of various sizes and best practices recommendations. (1) Each facility or part of a facility constructed by, on behalf of, or for the use of a public entity shall be designed and constructed in such manner that the facility or part of the facility is readily accessible to and usable by individuals with disabilities, if the construction was commenced after January 26, 1992. (2) Exception for structural impracticability. (i) Full compliance with the requirements of this section is not required where a public entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.

A Hugo Award-winning Novel! “Vinge is one of the best visionary writers of SF today.”-David Brin Thousands of years in the future, humanity is no longer alone in a universe where a mind's potential is determined by its location in space, from superintelligent entities in the Transcend, to the limited minds of the Unthinking Depths, where only simple creatures, and technology, can function. Nobody knows what strange force partitioned space into these "regions of thought," but when the warring Straumli realm use an ancient Transcendent artifact as a weapon, they unwittingly unleash an awesome power that destroys thousands of worlds and enslaves all natural and artificial intelligence. Fleeing this galactic threat, Ravna crash lands on a strange world with a ship-hold full of cryogenically frozen children, the only survivors from a destroyed space-lab. They are taken captive by the Tines, an alien race with a harsh medieval culture, and used as pawns in a ruthless power struggle. Available in PDF, EPUB and Kindle. Book excerpt: From Executive summary: This report focuses on the government's efforts to enforce federal civil rights laws prohibiting religious discrimination in the administration and management of federal and state prisons. Prisoners in federal and state institutions retain certain religious exercise rights under the Constitution and statutes including the Religious Land Use and Institutionalized Persons Act (RLUPIPA), the Religious Freedom Restoration Act (RFRA), and the Civil rights of Institutionalized Persons Act (CRIPA). Many states have similar provisions in their state constitutions and in state law modeled on RFRA. These rights must be balanced with the legitimate concerns of prisons officials, including cost, staffing, and most importantly, prison safety and security. Reconciling these rights and concerns can be a significant challenge for penal institutions, as well as courts.
