Book excerpt: This report considers the Fixed-term Parliaments Bill which would remove the Prime Minister's power to call an election at the time of his choosing, and sets a five year fixed term, subject to the possibility of early dissolution following a vote by the House of Commons. It examines the key issues of the Bill's principals as well as the process by which it was brought forward. The Committee takes the view that the origins and content of the Bill owe more to short-term considerations than to a mature assessment of enduring constitutional principles or sustained public demand. In the view of the majority of the Committee, the shift from a five year maximum to five year norm would inconsistent with the Government's stated aim of making the legislature more accountable; with existing constitutional practice; and with the practice of the devolved institutions and the clear majority in international legislatures. However the Committee does accept that an elected government should have a full term in which to develop their policies and take their legislative programme through Parliament. It considers a four year term should be adopted for any fixed-term arrangement at Westminster. Potential date clashes with elections to the devolved institutions should also be avoided. Some form of safety valve which would allow for an early election in circumstances such as the government losing the confidence of the Commons or where a political or economic crisis has affected the country is also necessary. The report also makes several specific recommendations for amendments for the Bill.

Book excerpt: The Commons Public Accounts Committee publishes its 61st Report of the Session which, on the basis of evidence from the Cabinet Office and HM Revenue and Customs (HMRC), examined tax disputes. At 31 March 2011 HM Revenue & Customs was seeking to resolve tax issues valued at over £25 billion with large companies, some of which included disputes over outstanding tax. In this report, the Committee expresses concern about how the Department handled some cases involving large settlements and that there needs to be proper separation between the negotiation of tax settlements and the authorization of such settlements. The Committee also states that HMRC made matters worse by trying to avoid scrutiny of these settlements, keeping confidential the details of specific settlements with large companies. This effects Parliament's ability to establish value for money, compounded further by imprecise, inconsistent and potentially misleading answers given by senior departmental officials, including the Permanent Secretary for Tax in particular over his evidence on his relationship with Goldman Sachs, in facilitating a settlement with the company over their tax dispute. HMRC governance processes in these matters were inconsistent and it has now appointed two new Commissioners with tax expertise, and plans to introduce a new assessor role to permit independent review of large settlements before they are finalised. The Committee further states that it saw little evidence of personal accountability within the Department, and that a perception has developed that large companies are treated more favourably, receiving preferential treatment compared to small businesses and individuals.

Book excerpt: The Government has set itself the challenging target of halving the number of children living in poverty by 2010-11 and eradicating child poverty by 2020. With 2010 fast approaching, Ministers are still committed to the targets, and the Committee wanted to ascertain whether DWP has the right measures in place to meet its objectives. Significant progress has been made, but the target remains challenging: there are still 2.8 million children living in poverty and the most recent data shows a slight increase in this number. The Committee is convinced of the damaging effect of poverty on a child's self-esteem and expectations, and also its effects in contributing to social exclusion. Children growing up in poverty are also more likely to have poorer health and poorer educational outcomes. There are groups of children who have a much higher risk of growing up in poverty, for example if they or a parent are disabled, and there are higher poverty rates amongst Pakistani, Bangladeshi and black children. Getting parents into sustainable work should be the focus of the strategy to lift them and their children out of poverty, but there are concerns that the Jobseekers' Allowance regime is not sufficiently flexible to reflect the complexity of lone parents' lives. To eradicate child poverty by 2020, the Government needs a long-term strategy on benefit income for those who are unable to work. If benefits are uprated in line with inflation, the gap between the incomes of those in work and those on benefits will only get wider, as benefits will not keep pace with earnings. As poverty is measured as a percentage of median earnings, the implications for the 2020 target, in particular, are serious.
