Los derechos fundamentales cumplen hoy en día varias funciones. A su función defensora clásica contra intrusiones en la esfera individual por parte del poder público, se vienen juntando otras: la protección contra violaciones de la libertad por parte de terceros, no en último lugar por actores sociales y económicos poderosos, y la protección contra riesgos tecnológicos, medioambientales y de la salud, así como funciones de prestación y de fomento para garantizar condiciones sociales que faciliten el pleno ejercicio de los derechos. Sin embargo, las funciones de protección y fomento incluyen un enfoque intervencionista que, por su lado, puede entrar en conflicto con la vertiente clásica de los derechos de libertad. De ahí surge la misión de encontrar un equilibrio entre las distintas funciones para hallar una solución que más favorezca la posición jurídica de cada persona. Es lo que RobeRt Alexy ha denominado tarea de optimización.

Este tipo de restricción (llamada sacrificial) de los derechos fundamentales ha ganado visibilidad en el debate público al hilo de polémicas recientes, como la posible vacunación forzosa de la población (con la finalidad de combatir una epidemia) o la indemnización de la prisión provisional seguida de absolución. No obstante, el problema del sacrificio de derechos ha sido, desde la Edad Media, una preocupación permanente de la filosofía política y del pensamiento europeo de corte constitucional, donde ha encontrado respuestas muy diversas que pueden proyectarse sobre los debates actuales. En el marco jurídico vigente, la restricción de tipo sacrificial exige la realización de dos juicios, uno ponderativo y otro adjudicativo, que sirven para conciliar armónicamente las cláusulas constitucionales de Estado de Derecho y Estado social. Las categorías dogmáticas que conforman la teoría general de las restricciones de los derechos fundamentales deben ser revisadas para que estos dos juicios (característicos de las restricciones sacrificiales) encuentren el lugar apropiado, sin caer en la hipertrofia de uno (proporcionalidad) y el desconocimiento del otro (indemnización).
