Download or read book EU Ordre Public written by Tim Corthaut and published by Kluwer Law International B.V.. This book was released on 2012-10-26 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a cogent, detailed analysis, the author ‘reconstructs’ the legal order of the European Union in a way that best gives meaning to the Treaties, the case law of the Court of Justice, and the various underlying principles of integration that have emerged over the decades. He focuses on instances, or touchstones, in relation to which EU law seems to be building and integrating an ordre public. Among these are the following: international trade law and arbitration; public international law; the ECHR and EctHR; public policy exceptions to the four freedoms; European citizenship; competition law; national and EU procedural law; and protection of social and labour standards. In-depth inquiry into questions which seem subject to very specific limitations – such as when national or EU courts are under an obligation to raise issues of EU law of their own motion, or norms from which private parties may not deviate – captures the breadth of the EU ordre public, greatly clarifying the concept and the variety of ways it operates. Seeking to reconcile numerous strands and processes of EU law in a principled manner, the book reveals a significant potential for a deeper constitutional framework defining the EU ordre public and putting it into operation as a tool to help ensure unity in diversity. It will be welcomed and read closely by jurists, policymakers, and interested academics in Europe and wherever the matter of European integration is studied.
Book Synopsis Business, Globalization and the Common Good by : Henri Claude de Bettignies
Download or read book Business, Globalization and the Common Good written by Henri Claude de Bettignies and published by Peter Lang. This book was released on 2009 with total page 456 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalization and information technology are driving the world into a new era. Is it the responsibility of business to pursue the common good - and more precisely, to participate in the construction of the global common good? This book brings together contributions from various disciplines, written by scholars who are at the forefront of this debate. It provides multiple insights into a tripartite relationship: business, globalization and the common good. It helps explain why the business sphere will probably not be in a position to ignore the common good much longer, and why this latter concept, widely ignored in today's management realm, is likely to become part of tomorrow's corporate policies and practices in the global context. Finally, this work opens up a plethora of avenues for future research, calling for the development of transdisciplinary approaches and for the elaboration of a research program embracing theoretical, empirical and spiritual perspectives to tackle this complex issue.
Book Synopsis L'ordre public écologique, du concept à la juridicité by : Collectif,
Download or read book L'ordre public écologique, du concept à la juridicité written by Collectif, and published by . This book was released on 2014-11 with total page 258 pages. Available in PDF, EPUB and Kindle.
Book Synopsis Coviability of Social and Ecological Systems: Reconnecting Mankind to the Biosphere in an Era of Global Change by : Olivier Barrière
Download or read book Coviability of Social and Ecological Systems: Reconnecting Mankind to the Biosphere in an Era of Global Change written by Olivier Barrière and published by Springer. This book was released on 2019-03-12 with total page 790 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book considers the principle of ‘sustainable development’ which is currently facing a growing environmental crisis. A new mode of thinking and positioning the ecological imperative is the major input of this volume. The prism of co-viability is not the economics of political agencies that carry the ideology of the dominant/conventional economic schools, but rather an opening of innovation perspectives through science. This volume, through its four parts, more than 40 chapters and a hundred authors, gives birth to a paradigm which crystallizes within a concept that will support in overcoming the ecological emergency deadlock.
Book Synopsis Human Health and Ecological Integrity by : Laura Westra
Download or read book Human Health and Ecological Integrity written by Laura Westra and published by Routledge. This book was released on 2012-05-31 with total page 389 pages. Available in PDF, EPUB and Kindle. Book excerpt: The connection between environment and health has been well studied and documented, particularly by the World Health Organization. It is now being included in some legal instruments, although for the most part caselaw does not explicitly make that connection. Neither the right to life nor the rights to health or to normal development are actually cited in the resolution of cases and in judges' decisions. This volume makes the connection explicit in a broad review of human rights and legal issues associated with public health and the environment. It will be particularly useful as many legal instruments emphasize the right to 'development' without fully discussing the necessary safety and public health aspects, and the respect for the ecology of any area where such 'development' (often unwanted by local or indigenous communities) is to be located. Climate change is another pressing variable that is considered, and several chapters address the interface between human health and ecological conditions. Overall the book integrates perspectives from a wide range of disciplines, including ethics, ecology, public health and epidemiology, and human rights and law.

Book Synopsis The Emergence of Biolaw by : Takis Vidalis
Download or read book The Emergence of Biolaw written by Takis Vidalis and published by Springer Nature. This book was released on 2022-06-20 with total page 319 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book introduces “biolaw” as an integrated and distinct field in contemporary legal studies. Corresponding to the legal dimension of bioethics, the term “biolaw” is already in use in academic and research activities to denote legal issues emerging mostly from advanced technological applications. This book is a genuine attempt to rationalize the field of biolaw after almost four decades of continuous production of relevant legislation and judgments worldwide. This experience is a robust basis for defending a) a separate legal object, covering the total of legal norms that govern the management of life as a natural phenomenon in all its possible forms, and b) an “evolutionary” approach that opens the discussion on a future conciliation of legal regulation with the Theory of Evolution on the ground of biolaw.
Book Synopsis L'ordre public écologique by : Marguerite Boutelet
Download or read book L'ordre public écologique written by Marguerite Boutelet and published by Emile Bruylant. This book was released on 2005 with total page 345 pages. Available in PDF, EPUB and Kindle.

Book Synopsis Leading Works in Law and Anthropology by : Alice Margaria
Download or read book Leading Works in Law and Anthropology written by Alice Margaria and published by Taylor & Francis. This book was released on 2024-07-16 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: The academic disciplines of law and sociocultural anthropology have a long but at times contentious history of drawing on each other in order to study and understand law and human experience in its diverse manifestations. This volume provides an innovative and engaging format by giving established and emerging scholars from diverse jurisdictions the opportunity to discuss and reflect upon what they consider to be a ‘leading work’. The collection offers a unique, multi-perspectival reconsideration of the intellectual history of the field whilst also addressing issues that are at the core of interdisciplinary legal research. Contributions shed light on the changing nature of cross-disciplinary research and collaboration, trace how disciplinary understandings of normativity have cross-fertilised each other, and reflect on choices taken within research on law and anthropology along a continuum of theoretical reflection, critique, engagement, and practical application. The book elaborates on the nature and the boundaries of law and anthropology research, as well as on its likely future development in light of the insights shared by contributors on their chosen leading works. The book will make fascinating reading for researchers and academics in both law and anthropology. Book Synopsis Global Environmental Constitutionalism by : James R. May
Download or read book Global Environmental Constitutionalism written by James R. May and published by Cambridge University Press. This book was released on 2015 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: Reflecting a global trend, scores of countries have affirmed that their citizens are entitled to healthy air, water, and land and that their constitution should guarantee certain environmental rights. This book examines the increasing recognition that the environment is a proper subject for protection in constitutional texts and for vindication by constitutional courts. This phenomenon, which the authors call environmental constitutionalism, represents the confluence of constitutional law, international law, human rights, and environmental law. National apex and constitutional courts are exhibiting a growing interest in environmental rights, and as courts become more aware of what their peers are doing, this momentum is likely to increase. This book explains why such provisions came into being, how they are expressed, and the extent to which they have been, and might be, enforced judicially. It is a singular resource for evaluating the content of and hope for constitutional environmental rights.
