Book excerpt: Applying practical tools to the volatile process of negotiating Prognosticators apply Monte Carlo Analysis (MCA) to determine the likelihood and significance of a complete range of future outcomes; Real Options Analysis (ROA) can then be employed to develop pricing structures, or options, for such outcomes. Richard Razgaitis' Dealmaking shows readers how to apply these powerful valuation tools to a variety of business processes, such as pricing, negotiating, or living with a "deal," be it a technology license, and R&D partnership, or an outright sales agreement. Dealmaking distinguishes itself from other negotiating guides not only by treating negotiations as an increasingly common situation, but also by presenting a tool-based approach that creates flexible, practical valuation models. This forward-thinking guide includes a variety of checklists, case studies, and a CD-ROM with the appropriate software. Richard Razgaitis (Bloomsbury, NJ) is a Managing Director at InteCap, Inc. He has over twenty-five years of experience working with the development, commercialization, and strategic management of technology, seventeen of which have been spent in the commercialization of intellectual property.

Available in PDF, EPUB and Kindle. Book excerpt: I am very pleased and proud to write the Foreword to this Book on the occasion of the Court of Arbitration for Sport (CAS) having completed its first twenty years of operations. And I warmly congratulate the ASSER International Sports Law Centre and the Editors, Ian Blackshaw, Rob Siekmann and Janwillem Soek – in cooperation with Andrew Gibson, Griffith University, Brisbane, Australia, and Steve Cornelius, University of Johannesburg, South Africa –, on their joint initiative in putting together and publishing this Book. The CAS has come a long way since the idea of establishing it was first mentioned by Juan Antonio Samaranch, the former IOC President. His vision and confidence in its future have been truly vindicated. Since its creation and up to 31 December 2003, 576 cases have been submitted, of which 550 were requests for arbitration and 26 for an advisory opinion. In 2004, there was a sharp rise in the number of cases handled by the CAS and this trend continues apace. Thus, the CAS goes from strength to strength and has a great future, having, in the words of the Swiss Federal Tribunal in its landmark judgement of 27 May 2003, “built up the trust of the sporting world [and] . . . now widely recognised . . . [as] . . . one of the principal mainstays of organised sport.

Available in PDF, EPUB and Kindle. Book excerpt: Critical Studies in Private Law discusses the prerequisites and possibilities for an alternative or critical legal dogmatics. The starting point of the analysis is the recognition of contradictions within the legal order. In this respect the theory may use the experience of both American Critical Legal Studies and the German attempts to formulate a legal theory for the social state. The key for understanding how the contradictory concrete legal material may produce varying results on the level of legal decisions is the systematization, the general principles of the law. The analysis does not, however, stop at this theoretical level. The methodology is tested through a discussion of some features of modern private law. Some key elements of contract law, including consumer law, of the Welfare State are singled out. The work focuses on the person-orientation of modern law as a challenge to the traditional abstract legal form. The aim is to explore the limits for a contract law radically oriented towards the personal social and economic needs of the parties. This endeavour involves the creation of new legal concepts such as social force majeure.

Book excerpt: Sports law has been growing rapidly over the last few years, regularly making headlines as well as leading to a developing body of law practised by specialist lawyers. This new work, by leading practitioners in the field, is the first to provide a coherent framework for understanding the law in this area, as well as a deep analysis of its key features. The subject can be split into various areas of practice. For example regulatory rules, which cover what can be described as the constitutional aspect of organised sport (this includes the enforcing of regulatory codes and the disciplinary procedures of the various sport governing organisations). Second, broadcasting and marketing which covers the revenue generated by the commercial exploitation of sports clubs, sporting events and players. This area has grown rapidly following the huge infusion of finance from television and corporate sponsorship into a growing number of sports. A third area is player representation, which focuses on the players and includes a broad range of legal issues including club transfers and player contracts (including the famous Bosman ruling), employment advice, personal injury litigation, disciplinary tribunals, discrimination law and remedies in the courts. The audience is solicitors and barristers, legal advisers to sports organisations and clubs, legal advisers to corporations and media companies, academics teaching sports law, sports administrators and law libraries.

Academics and practitioners are still in debate to agree on this concept as is evident in this book. This book not only contains the worked out contributions of this Conference, but also other related chapters on the subject. It produces a reassessment of the content of Sports Law and its terminology keeping a close eye on the current literature. The book appears in the ASSER International Sports Law Series, under the editorship of Prof. Dr. Robert Siekmann, Dr. Janwillem Soek and Marco van der Harst LL.M.

The issue concerns a battle waged by Jean Marc Bosman, a Belgian professional footballer, to secure his freedom of labour. The judgement of the European Court of Justice settled the European dimension of the dispute. The landmark decision made by the European Court applies to all professional players who are nationals of member states and active in the European Union, and also covers EFTA countries. The book includes a full analysis and history of the Bosman cases, and is supported by the relevant regulations, statutes and transcripts of the court proceedings.

Spain, the Court of Justice of the European Union extended the fundamental right for privacy protection, concluding that search companies, in some circumstances, could be required to remove links to private facts. The decision provoked widespread discussion but one of the key voices was often not present. "The Right to be Forgotten on the Internet: Google v. Spain," authored by the former Spanish Data Protection Commissioner and now available in English for the first time, charts the history of the case and describes the key arguments underlying this landmark decision. Artemi Rallo details the earlier disputes before the Spanish Data Protection Agency, the Google v. Spain decision itself, European scholarship and related legislation, as well as significant precedents from European, American, and international courts. Rallo, who is also a Constitutional law professor, provides a thoughtful, detailed account of one of the most significant privacy cases of the modern age.

It central thesis is that globalization of law tends to create a decentred law-making process which occurs in multiple sectors of civil society, independently of nation states. Technical standardization, professional rule production, human rights, intra-organizational regulation in multinational enterprises, contracting, arbitration and other institutions of lex mercatoria are forms of rule by private governments, claiming world-wide validity independently of the law of the nation states. They have come into existence not by formal acts of nation states but by strange paradoxical acts of self-validation.

Available in PDF, EPUB and Kindle. Book excerpt: I am honoured to have been invited to write the foreword to this book. Since the publi- tion of Professional Sport in the EU: Regulation and Re-regulation (edited by Andrew Caiger and Simon Gardiner, T.M.C. Asser Press 2000), there have been a number of dev- opments in the European Union in sports law, both in the European Commission and the European Court of Justice. The most significant of these was probably the adoption by the Commission of the White Paper on Sport on 11 July 2007. The White Paper takes stock of the acquis communautaire – the rather prodigious body of European Law including judgements and preliminary rulings of the ECJ – in the sports field and sets out the position of the Commission on three significant aspects of European sport: its societal role, its economic dimension, and its governance. The White Paper also contains concrete proposals for further EU action as part of an Action Plan named after Pierre de Coubertin, the founder of the modern Olympic Games.
