Book excerpt: Seminar paper from the year 2011 in the subject Business economics - Business Ethics, Corporate Ethics, grade: A, Union Graduate College, course: Managing Ethically in a Global Environment, language: English, abstract: “When in Rome, do as the Romans do” [1] is a saying that exists in many cultures all over the world. Although it is very old – it can be traced all the way back to the days of St. Ambrose in the fourth century – it briefly describes on of the major challenges companies face in today’s globalized economy. Should they follow a universal code of business behavior or adapt to the customs in a particular country. A classic case for this question is the Lockheed Case. In the early 1970s Lockheed had serious economic problems. Facing bankruptcy it secured a government loan of $250 million in 1970. In 1972 and 1973, briberies of the Japanese government were revealed. It turned out that the President of Lockheed, A. Carl Kotchian, authorized secret payments of $12 million to representatives of the Japanese Prime Minister, Kukeo Tanaka, to secure sales contracts in the Japanese aircraft market. As a result, both Prime Minister Tanaka and CEO Kotchian had to resign. Lockheed’s contracts in Japan were cancelled. A consequence of these incidents is the Foreign Corrupt Practices Act of 1997 that prohibits American corporations making payments to foreign governments to advance their business interests. In this paper, I will discuss certain topics related to this case and show, why Kotchian did not exhibit ethical behavior in his role as President of Lockheed.

Available in PDF, EPUB and Kindle. Book excerpt: The book presents a collective action perspective to explain how extraterritoriality functions and assess when, and to what extent, extraterritoriality is effective. A collective action perspective provides a new account of foreign anti-bribery laws and their extraterritorial enforcement that draws on theories discussed in the field of economic governance. Within this framework, the book offers an intensive analysis of US foreign anti-bribery law such as the Foreign Corrupt Practices Act (FCPA), international law as it emanates from the OECD Anti-Bribery Convention, and comparative insights into UK law and German law. To test the theory in practice, the book provides a unique data set of more than 40 foreign anti-bribery enforcement actions conducted by the US Department of Justice (DOJ) and the Securities and Exchange Commission (SEC), and other examples from comparative jurisdictions. Extraterritoriality and International Bribery is ideal reading for academics and students with an interest in global governance, economic crime, criminology, and law and economics, as well as practitioners concerned with foreign anti-bribery enforcement, including compliance officers, lawyers, investigating and prosecuting authorities, and business leaders. The book also discusses governance alternatives existing outside international anti-bribery law and offers policy and legal reforms proposals. The book suggests a decentralized enforcement model with the delegation of some enforcement tasks to an external body as the most appropriate governance alternative.

Available in PDF, EPUB and Kindle. Book excerpt: Corruption scandals receive significant press coverage and scrutiny from practitioners of global governance, and bilateral and multilateral donors. Across the globe, the annual publication of TI’s CPI and World Bank’s Worldwide Governance Indicators elicits spirited denials and accusations of targeting, of neo-colonialism. Poor measures on corruption indices and the ensuing negative publicity can have serious consequences both externally, through a freeze or retraction of donor funding, and internally, through reducing the availability of public funds, and harming the credibility of serving governments and institutions. Corruption Scandals and their Global Impacts tracks several major corruption scandals across the world in a comparative analysis to assess the full impact of global corruption. Over the course of the book, the contributors deliberate the exposure and reporting of corruption scandals, demonstrate how corruption inhibits development on different levels and across different countries, the impact it has on the country in question, how citizens and authorities respond to corruption, and some local, regional and global policy and legislative measures to combat corruption. The chapters examine the transnational manifestation of corruption scandals around the world, from developed countries and regions such as the United States and the European Union, to BRIC countries Brazil and Russia, to developing countries such as Belarus, Jamaica, Kenya and Nigeria. In each case, chapters highlight the scandal, its impact, the local, regional and global responses, and the subsequent global perceptions of the country. Concluding with a review of the global impacts of corruption scandals, this book provides an important comparative analysis which will be useful to students and scholars of international development and politics, as well as to development practitioners, donors, politicians and policy makers.

Available in PDF, EPUB and Kindle. Book excerpt: The Spirit of Japanese Law focuses on the century following the Meiji Constitution, Japan's initial reception of continental European law. As John Owen Haley traces the features of contemporary Japanese law and its principal actors, distinctive patterns emerge. Of these none is more ubiquitous than what he refers to as the law's "communitarian orientation." While most westerners may view judges as Japanese law's least significant actors, Haley argues that they have the last word because their interpretations of constitution and codes define the authority and powers they and others hold. Based on a "sense of society," the judiciary confirms bonds of village, family, and firm, and "abuse of rights" and "good faith" similarly affirms community. The Spirit of Japanese Law concludes with constitutional cases that help explain the endurance of community in contemporary Japan.

Book excerpt: This book exposes how US plutocrats launched Hitler, then recouped Nazi assets to lay the post-war foundations of a modern police state. Fascists won WWII because they ran both sides. Lays bare the tenacious roots of US fascism from robber baron days to Reichstag fire to the WTC atrocity and "Homeland Security", with a blow-by-blow account of the fascist take-over of America's media.
