Leur émergence bouscule le paradigme de la souveraineté étatique en ce qu’elle conduit à restreindre fortement la compétence migratoire des États membres. Il ne peut être envisagé dans un cadre d'intégration supranationale. Il constitue cependant une préoccupation majeure de l'intégration européenne. L'étude du statut des ressortissants de pays tiers nécessite la fixation d'un cadre général, définissant avec précision les personnes concernées, les compétences pour agir et le territoire d'application du statut. Une catégorie spécifique de ressortissants de pays tiers apparaît. Les membres de la famille de ressortissants communautaires et les bénéficiaires de certains accords de la communauté européenne semblent bénéficier d'un statut particulier. La recherche d'un titre de compétence à l'égard des ressortissants de pays tiers pose le problème de l'interprétation de la notion de marché intérieur. S'il ne paraît pas possible de déceler, dans le traité instituant la CEE, une base de compétence générale, des titres de compétences spécifiques apparaissent. Le Traité de Maastricht confère à l'Union une compétence, dans le cadre des questions d'intérêt commun. Cependant, certaines interférences apparaissent, avec le pilier communautaire de l'union. Le Traité d'Amsterdam vient opportunément clarifier la question. Il reste alors à déterminer le territoire d'application de ce nouveau droit. La formation d'une politique d'asile et d'immigration de l'Union européenne soulève de nombreuses difficultés. Le choix de la méthode, en matière d'immigration, révèle certaines oppositions sur le contenu du statut des étrangers. A l'efficacité "Schengen" s'oppose la méthode communautaire, souvent laborieuse. L'intégration de l'acquis de Schengen dans le nouveau traité pourra, à cet égard, doter l'Union d'une plus grande efficacité. La politique d'asile, guidée par des principes humanitaires, est fondée sur la Convention de Genève. Les insuffisances de celles-ci mettent en évidence la nécessite d'élaborer une politique européenne des refugiés de facto.

Ce phénomène concerne tant les ressortissant·e·s de pays tiers que les citoyen·ne·s européen·ne·s. Le concept d'intégration est ainsi tourné à toutes les sauces par les politiques et législateurs, ce qui rend sa compréhension et sa justiciabilité particulièrement compliquées et ouvre la porte à de nombreuses dérives dans l'utilisation qui en est faite en droit. Alors qu'il fait l'objet de nombreux débats en sociologie, sciences politiques et philosophie - notamment sur la question des modèles nationaux parmi lesquels les modèles multiculturaliste et assimilationniste - son aspect juridique est trop souvent ignoré au sein de ces discussions. Le présent article entend pallier ce vide dans la littérature en proposant, sur la base de nombreuses illustrations empruntées aux droits européen, belge et néerlandais, une typologie relative à la manière dont l'intégration est mobilisée en droit. Cette typologie a pour objectif non seulement de créer des ponts entre les différentes disciplines mais également de développer des outils pour les praticiennes et chercheur·euse·s afin d'avoir une compréhension plus fine de la manière dont le concept d'intégration est utilisé par les législateurs, gouvernements et interprété par la Cour de justice de l'Union européenne. À l'instar du statut de ressortissant communautaire, devenu citoyen de l'Union, le statut de ressortissant d'un pays tiers se construit d'abord autour des questions économiques, s'inscrivant parfaitement dans l'objectif de réalisation d'un marché unique, dont la liberté de circulation est un instrument essentiel. Pourtant, droit fondamental de chaque citoyen européen, la liberté de circulation reste encore subordonnée aux conditions économiques pour le ressortissant d'un pays tiers. En même temps, l'Union européenne se détache progressivement de son atavisme économique, d'une Europe économique on se dirige vers une Europe sociale. La solidarité économique est complétée par une solidarité sociale, permettant ainsi au ressortissant d'un pays tiers d'avoir accès aux droits sociaux communautaires. Le critère de nationalité, comme condition d'accès aux droits de la citoyenneté sociale européenne, s'affaiblit cédant sa place à un nouveau critère, la résidence régulière. Par conséquent, la citoyenneté sociale européenne, et, notamment, les droits rattachés à celle-ci, s'ouvrent aux ressortissants des États tiers régulièrement établis sur le territoire d'un État membre. La dimension économique du statut de ressortissant d'un État tiers s'enrichit par une dimension sociale et devient ainsi plus proche de celui de citoyen de l'Union.
