This book was released on 2013-10-27 with total page 288 pages. Available in PDF, EPUB and Kindle. The start of the bilateral legislation with the minority confessions and the doubling of the number of agreements, thanks to those stipulated in 2007 that led to negotiation with the State new confessions different from those historically held on the Italian territory, due to the increase of immigration, produced relevant changes and introduced new problems that also affect the institution of marriage. Therefore the study of the religious marriage of non-catholics, whose civil effectiveness has been recognized from 1929 following the enactment of the General Law n. 1159/29 and R.D. n. 289/30, is getting more and more topical. The importance of this legislation, has declined since 1984 when signing the first agreement with the Waldensian Committee, started the practical implementation of the system of bilateral negotiation (art. 8. p. 3 Const.). The consequence was the end, for the eleven confessions that attained this historical goal, of the provisions of the General law mostly clashing with the values guaranteed by our Constitution. The provisions contained in the agreements on marriage were then examinated and compared with the corresponding provisions of the law of 1929, also giving emphasis to the problems raised by their application. It was finally attempted to verify if the changes due to the 1984 bilateral legislation (Agreement with the Catholic Church and with the minority confessions) to proceedings held to give civil importance to the religious marriage, might constitute the beginning of a process in which the different form of the religious marriage tend to homologate.

Book excerpt: This book examines the vre of Anna Maria Ortese (1914-1998) from her first literary writings in the Thirties to her great novels in the Nineties. The analysis focusses on two interweaving core themes, loss and the Other. It begins with the shaping of personal loss of an Other following death, separation, abandonment, coupled with melancholy for life's transience as depicted in autobiographical works and in her masterpiece Il porto di Toledo. The book then addresses Ortese's literary engagement with social themes in realist stories set in post-war Naples in her collection Il mare non bagna Napoli and then explores her continuing preoccupation with socio-ethical issues, imbued with autobiographical elements, in non-realist texts, including her masterful novels L'Iguana, Il cardillo addolorato and Alonso e i visionari The book combines theme and genre analysis, highlighting Ortese's adoption and hybridization of diverse literary forms such as poetry, the novel, the short story, the essay, autobiography, realism, fairy tales, fantasy, allegory. In her work Ortese weaves an ongoing dialogue with literary and non-literary works, through direct quotations, allusions, echoes, adoption of motifs and topoi. The book thus highlights the intertextual relationship with her sources: Leopardi, Dante, Petrarch, Manzoni, Collodi, Montale, Serao; Shakespeare, Milton, Keats, Blake, Joyce, Conrad, Melville, Poe, Hawthorne, Hardy; Manrique, Gongora, de Quevedo, Villalón, Bello, Cantar del mio Cid; Heine, Valery, Puccini's Madam Butterfly, folklore, popular songs, and the Bible. Ortese thus shapes her literary themes in the background of social, political and economic upheavals over six decades of Italian history, culminating in an allegorical critique of modernity and a call for a renewed bond between humans and the Other.

Book excerpt: Coppa provides the first full-length study of Giacomo Antonelli, friend and advisor to Pope Pius IX (Pio Nono) and his Secretary of State and chief minister from 1849 to 1876. Based on the documents of the secret Vatican Archives, and neglected family papers in the State Archive in Rome, the book gives an important reevaluation of this key diplomatic figure, separating the man from the myth and delving into his character and policies. The book examines both the personality and policies of the Cardinal, who was seen to be the Pope’s Richelieu and Mazarin combined. Confronting the polemical literature which has charged him with sexual misconduct and venality, the study examines his early formation and career, the inspiration for his European policies, his relationship to Pio Nono, and the part he played in the Counter-Risorgimento and the Papal reaction. By improving our understanding of Papal, Italian, and European developments during these crucial decades, this study provides new insights into Rome’s fortress mentality and its rejection of the main currents that were transforming western life— currents that influenced not only the Catholic Church but European society as a whole.

At the same time opinion polls repeatedly demonstrate that the public knows little about crime and justice, and holds negative views of the criminal justice system. This book, consisting of chapters from leading authorities in the field, is concerned to address this problem, and draws upon research in a number of different countries to address the issues arising from this state of affairs. Its main aims are: to explore the changing and evolving nature of public attitudes to sentencing to examine the factors that influence public opinion and to bring together recent international research which has demonstrated ways in which public attitudes can be changed to propose specific strategies to respond to the crisis in public confidence in criminal justice.

Available in PDF, EPUB and Kindle. Book excerpt: This edited volume explores the relationship between constitutionalism and populism in the Italian context. Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.
