Book excerpt: La tesis doctoral estudia determinadas cuestiones en torno a la incidencia en la rehabilitación urbana de preceptos de la vigente ley del suelo y de la ley del patrimonio histórico español. En concreto: la aptitud de los planes especiales de reforma interior y de los planes para la protección de conjuntos históricos para regular operaciones de rehabilitación integrada, así como su aptitud para modificar, en determinados casos previsiones de plan general.La incidencia del régimen de fuera de ordenación recogido en la ley del suelo en las tareas rehabilitadoras. Se conceptúa la ratio legis de este precepto, conforme a la cual debe ser interpretado y aplicado. Se analiza la capacidad de instrumentos generales de planeamiento para modular, matizar o sustituir el régimen de fuera de ordenación tal y como lo recoge la ley del suelo. Se estudia la relación de este régimen con las circunstancias urbanísticas que aconsejaren la demolición del inmueble como causa de declaración de ruina recogida en el art. 183.2.c) de la ley del suelo. La declaración de ruina y su relación con la declaración de bienes de interés cultural es, así mismo, objeto de estudio y análisis.
