Book excerpt: En trente-quatre ans d'existence depuis sa première signature, la Convention des Nations Unies sur le droit de la mer qui est entrée en vigueur le 16 novembre 1994, avait été conclue pour mettre en place des lignes directrices des droits et des obligations des États concernant l'utilisation des océans, définissant ainsi des normes spécifiques pour la gestion des ressources marines naturelles. La Convention continue toutefois d'alimenter les discussions et les négociations concernant la réglementation de l'exploitation des ressources halieutiques hauturières. Des parties lointaines des océans qui sont longtemps restés protégées de toute intrusion humaine, à l'exception de quelques navires en transit, et d'une pêche pratiquée au large des côtes, connaissent aujourd'hui des pressions considérables. En effet, à l'opposé des zones marines sous souveraineté (mer territoriale) ou sous juridiction de l'État côtier (zone économique exclusive), la liberté de pêche dans les eaux internationales est consacrée sur le plan juridique. Elle doit potentiellement profiter à tous les États, côtiers ou non; aucune discrimination juridique n'est alors envisagée. Cependant, cette liberté est mise en mal sur le plan pratique; les États possesseurs d'importants moyens de pêche rendent le principe illusoire. Cela aboutit à une surpêche, à une exploitation non rationnelle et déraisonnable des ressources halieutiques. Dès lors, l'on s'interroge sur le respect de l'équité, sur le sort de la gestion durable desdites ressources. De ce fait, comment concilier la liberté de pêche dans les eaux internationales avec l'impératif d'une gestion durable de ces ressources, afin qu'elle puisse profiter à tous les États? Au-delà de l'influence des considérations politico-juridiques qui ont quelque peu dénaturé l'essence même de la notion de patrimoine commun de l'humanité attribuée aux ressources minérales du fond de la haute mer (en dissociation des ressources halieutiques appartenant pourtant au même espace marin), la réalisation de cet impératif passe par l'attribution de la gestion des pêcheries hauturières à une organisation internationale de service public.

Cependant 5% de celles-ci se trouvant en haute mer sont restées soumises au principe de la liberté de la pêche. Le constat de leur surexploitation a impliqué la mise en œuvre permettant la rationalisation de l'exploitation des ressources biologiques de la haute mer. Pour réaliser cet objectif, les états ont tendance, soit à chercher à s'approprier les ressources à leur seul profit, soit à les gérer au profit de l'humanité. La première tendance a été exprimée par des états tant pêcheurs que côtiers. Les premiers se sont regroupés en organisation régionales pour accaparer les ressources au détriment des états en développement. Les états côtiers ont tenté d'étendre leurs compétences au-delà des ZEE pour imposer une gestion plus rationnelle des ressources. Dans les deux cas les états tendent à s'assurer l'appropriation des ressources d'une manière contraire au principe de la liberté et donc au droit international. Face à ces tentatives, la communauté internationale cherche à imposer des règles internationales permettant d'établir une gestion internationale des ressources au profit de l'humanité. L'exploitation devant être aménagée en fonction des conditions locales, la gestion est organisée au sein d'organisations régionales.

For the high seas, it agreed that there should be a separate instrument, outside of the FAO, with the power to take binding decisions on conservation and management measures. The Consultation recognized the right of involvement of coastal States in the high seas instrument and identified linkages between the proposed coastal State and the high seas arrangements. The Consultation also agreed on the draft text for a resolution to the FAO Council and for the statutes of a regional body for the management and development of coastal fisheries.
