Book excerpt: The era of liberal interventionism is over, and the prevailing international discourse is once again about defending state borders and putting up walls. This broad re-assertion of sovereignty and non-intervention—-often considered the normative foundation of the BRICS countries, of the Non-Aligned Movement, of Bandung, of the “Westphalian” South—-raises a series of difficult questions, not least about the management of challenges shared by all. How are we to make sense of re-organisations of intervention and non-intervention in global order? Recently the dominant way of approaching these issues has been through the lens of cosmopolitan or liberal-solidarist duties, including the Responsibility to Protect. Yet it seems doubtful that this framework is still capable of posing the right questions or generating the right sorts of answers. This volume offers a new approach that provincializes the conventional debate, de-naturalises what it takes as universal or given, and lays out a series of alternatives at a time when non-intervention, quite suddenly, seems everywhere in the discourse of international society. It does so through a genealogy of the intervention concept since 1945. Intervention before Interventionism is about the ways in which statespeople have re-ordered intervention and non-intervention since the middle of the twentieth century; it is concerned primarily with non-Western contestations of Western-dominated order; it illustrates institutional change in and through decolonization; and it provides a conceptual roadmap for understanding dilemmas of intervention and non-intervention today, particularly in relation to contestation as it has re-emerged in the twenty-first century. While building upon and conversing with existing literature, the book stands out from previous approaches insofar as it is a mapping of international struggles for the re-constitution of intervention in the globalization of the society of states.

Since the establishment of the first UN peacekeeping mission, UNEF I, in 1956, international lawyers have raised questions about the legal aspects of these operations. Traditionally, they analyzed the constitutional basis for peacekeeping and tried to allocate the authority under the UN Charter for peacekeeping among the Security Council, the General Assembly and the Secretary General. This book looks at the aim of Islamic State to create an effective government, with an economically independent regime, which focused on key oilfields in Syria and Iraq. Having addressed Islamic State's quest for energy resources in Iraq and Syria, the book explores the lawfulness of the war with Islamic State from a variety of legal aspects. It has been attempted to make inroads into the most controversial aspects of contradictions in the application of jus ad bellum and jus in bello, particularly when discussing the use of extraterritorial armed force against ANSAs, and the obligation to protect civilian objects, including the natural environment. The question is whether the targeting of energy resources should be regarded as a violation of the laws of armed conflict, even though the war with Islamic State being classified as a non-international armed conflict. Ambitious in scope, the study argues that legal theory and state practice are still problematic as to how and under what conditions states can justify resorting to military force in foreign territory, and to what extent they can target natural resources as being part of state property. Furthermore, it goes on to examine the differences between international and non-international armed conflicts, to establish whether there is any difference in the targeting of energy resources as part of the war-sustaining capabilities of either party. Through an examination of the Islamic State case, the book offers a comprehensive study to close the gaps in jus in bello by contextualising the questions of civilian protection, victimisation and state responsibility by evaluating the US's war-sustaining theory as a justification for the destruction of a territorial state's natural resources that are occupied by ANSAs.

The issues surrounding sovereignty and jurisdiction are likely to become ever more pressing as globalisation, growing pressure on resources and the need for energy and national security become acute, and the resolution of special delimitation disputes seems likely to become a vital question in the twenty-first century. As a result of the fast pace of technological developments in air and space activities and the massive increases in air transportation , satellite communications and space exploration, the need for scholars and practitioners to sharpen their appreciation of the legal and political issues becomes crucial. This book will focus primarily on the issues of sovereignty jurisdiction and control in airspace and outer space and their effects on public and private activities, but it will also look at related issues pertaining to the Seas and Antarctica. Commercial exploitation, resource control and the international regime regulating contractual obligations in relation to transportation of goods and services over all forms of territory will be examined to the extent that they are necessary to explain jurisdictional rights and duties over territory. Older problems of international law such as crimes in the air and airspace trespass are treated along with newer developments such as space tourism as well as growing demand for private ownership and involvement in outer space exploitation. The book goes on to consider the distinction between airspace and outer space and puts forward legal criteria which would allow for the resolution of the spatial delimitation dispute. These criteria would determine where in spatial terms the exclusive sovereignty of airspace ends and where outer space – the province of all mankind – begins, and contribute to the jurisprudence of territorial sovereignty and jurisdiction.
