Book excerpt: Aside from self-defence, a UN Security Council authorisation under Chapter VII is the only exception to the prohibition on the use of force. Authorisation of the use of force requires the Security Council to first determine whether that situation constitutes a ‘threat to the peace’ under Article 39. The Charter has long been interpreted as placing few bounds around how the Security Council arrives at such determinations. As such commentators have argued that the phrase ‘threat to the peace’ is undefinable in nature and lacking in consistency. Through a critical discourse analysis of the justificatory discourse of the P5 surrounding individual decisions relating to ‘threat to the peace’ (found in the meeting transcripts), this book demonstrates that each P5 member has a consistent definition and understanding of what constitutes a ‘threat to the peace’.

Some even suggest that the very future of the United Nations, in particular the Security Council and its collective security system, is at risk - at least in its current form. This book does not address the question of the future of the United Nations, an issue probably best left to scholars of international relations. Instead, it seeks to place the 'war on terror' within the context of international law, assessing how, or whether, it can be accommodated within the existing legal framework limiting the use of force. Through an examination of the lawfulness (or otherwise) of both Operation Enduring Freedom and Operation Iraqi Freedom, including the legal justifications advanced by those states involved and the reaction of the international community, and involving a detailed discussion of the most important developments (ie, the permissibility of self-defence against non-state, terrorist, actors and the 'Bush doctrine' of pre-emptive self-defence against terrorists as proclaimed in the 2002 US National Security Strategy) the book determines whether, and to what extent, the right to use force - or the acceptability of such military action - is currently undergoing a radical transformation. Book excerpt: This book describes the problems encountered by UN inspection teams assigned to find and destroy Iraq’s nuclear, chemical, biological, and missile capabilities following Desert Storm. Kathleen C. Bailey focuses on the initial inspections—the period in which Iraq was struggling to camouflage and conceal its weapons and production equipment as inspectors were trying to define their role in the process. Working from interviews with these initial inspectors, Bailey extracts important lessons for future verification efforts. On-site arms control inspectors in Iraq found information to be carefully controlled by the government. Pertinent documentation was destroyed, only selected people were allowed to interact with inspectors, and officials refused to make full, complete declarations. Buildings were tom down, equipment was moved, and un-exploded ordnance was placed in the way. These and other techniques helped Iraq to hide its past activities and to preserve some of its weapons capabilities. In the future, arms control inspectors will need to develop strategies for dealing more effectively with recalcitrant inspectees and for creating the best possible procedures and processes. Bailey concludes with concrete suggestions for overcoming some of these obstacles with more effective inspection practices.
