Book Synopsis Droits de l'investisseur étranger et protection de l'environnement by : Sabrina Robert-Cuendet

This book was released on 2010-05-12 with total page 546 pages. Available in PDF, EPUB and Kindle. In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

Book Synopsis Regulation Theory and Sustainable Development by : Corinne Gendron
Download or read book Regulation Theory and Sustainable Development written by Corinne Gendron and published by Routledge. This book was released on 2013-03-01 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book argues that current economist theories do not take into account the socially constructed nature of the debate surrounding the environment and environmental policy. It examines whether proposed economic solutions to environmental policy are, in fact, viable in practice. The book demonstrates that social conflicts cause policy compromises, which shape the economic system of a post-industrial ecological society. The author offers an innovative socio-economic theory of environmental politics, which illuminates the transformation dynamics brought about by the ecological crisis. Regulation Theory and Sustainable Development will be of interest to students and scholars of environmental politics, policy and governance.

Book Synopsis Traditions and Change in European Administrative Law by : Roberto Caranta
Download or read book Traditions and Change in European Administrative Law written by Roberto Caranta and published by Apollo Books. This book was released on 2011 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: The background to this collection of paper is formed by the changes in contremporary society. In modern-day western societies it is the thought that individualism trumps collectivisim. There is change from the paradigm of hierarchy to a paradigm of cooperation. This effects administrative law, which is traditionallly top-down, but is slowly accepting and incorporating mechanism of negotiation and bottom up involvement of stakeholders and concerned individuals. The contributors to his volume investigate, these changes in administrative law and provide an assessment as to whether and to what extent they are reflected in the way judicial review of governmental action is shaped. The analysis covers the EU and a number of EU jurisdictions (France, Germany, United Kingdom, the Netherland, Italy and Romania.) representing different administrative law traditions and being differently responsive to change. To provide an outside comparision, the US administrative system is also covered. Book jacket.
