Pourtant, en l'absence de la nécessité thérapeutique indissociable de l'acte médical normal, cette matière réclame l'existence de règles spécifiques adaptées. Tel est la démonstration de la présente étude. La première partie dresse le bilan de la responsabilité médicale caractérisée principalement par les devoirs de conscience et de science du médecin, et explique comment la chirurgie esthétique s'est intégrée dans ce corps de règles général. La seconde partie traite de l'encadrement spécifique que les juges ont tenté d'imposer aux chirurgiens esthétiques, spécificité limitée par le législateur. Pourtant, l'acte de chirurgie esthétique se banalisant et n'étant pas l'écho d'un besoin lié à la santé, se doit d'être encadré par un régime de responsabilité renforcée qui peut notamment être trouvé dans le droit de la consommation ou dans les principes généraux du droit de la protection de la dignité et de l'intégrité physique.
