L’intérêt doctrinal porté au statut personnel n’est pas anodin, il est relatif à la nature de cette matière. Celle-ci touche à l’organisation de la famille. Constituant la cellule de base de la société, le droit qui l’organise est demeuré intimement lié aux mœurs, aux traditions, à la culture des populations et à la religion. Pour les pays arabes de confession musulmane, la famille, comme institution protégée, fut largement réglementée par le Coran qui, dans certains domaines, atteint une précision peu commune. Il est donc beaucoup plus difficile pour le législateur ou le juge de s’en éloigner dans les pays où la référence religieuse est prégnante, au risque d’être confronté à des résistances politico-religieuses et à des rejets identitaires. Ce n’est pas non plus un hasard si ce droit est resté jusqu’à présent un espace surprotégé dans lequel se réfugient les pays arabes, d’une part pour préserver leur spécificité religieuse et d’autre part, pour revendiquer un particularisme juridique contre les nouvelles valeurs que véhiculent les pays occidentaux. C’est surtout le contenu de cette matière et la conception qu’elle véhicule qui feront ses spécificités. Celles-ci s’articuleront principalement autour de deux axes : le droit religieux et le statut des femmes.

Elle propose la technique de l'harmonisation pour résoudre les problèmes de divergences et de contradictions qui caractérisent cette matière juridique. En partant de l'observation de certains Etats qui ont réalisé des réformes au niveau du statut personnel, on s'aperçoit que l'intervention dans cette matière soulève constamment la question de sa conformité au regard du référentiel religieux. Enjeu à la fois politique et religieux, objet de convoitise de la part des fondamentalistes, le statut personnel pose actuellement de véritables problèmes : discrimination envers les femmes, incompatibilité avec la conception universelle des droits de l’Homme, attachement à une normativité religieuse, souvent ambigüe et divergente. Il est évident que ces pays aspirent à trouver des solutions pratiques, les dernières réformes au Maroc et en Egypte, le confirment. Cependant, et en même temps, ces pays sont tiraillés et ne savent pas comment évoluer en évitant l’écueil d’une modernisation imposée niant leurs spécificités juridiques et religieuses. L'harmonisation, comme technique de rapprochement normative pourrait apporter des solutions conciliatrices et mettre ainsi de l'ordre dans une matière qui a trop longtemps cultivé les divergences doctrinales. Book excerpt: This book contains selected contributions presented during the workshop “Establishing Filiation: Towards a Social Definition of the Family in Islamic and Middle Eastern Law?”, which was convened in Beirut, Lebanon in November 2017. Filiation is a multifaceted concept in Muslim jurisdictions. Beyond its legal aspect, it encompasses the notion of inclusion and belonging, thereby holding significant social implications. Being the child of someone, carrying one’s father’s name, and inheriting from both parents form important pillars of personal identity. This volume explores filiation (nasab) and alternative forms of a full parent-child relationship in Muslim jurisdictions. Eleven country reports ranging from Morocco to Malaysia examine how maternal and paternal filiation is established – be it by operation of the law, by the parties’ exercise of autonomy, such as acknowledgement, or by scientific means, DNA testing in particular – and how lawmakers, courts, and society at large view and treat children who fall outside those legal structures, especially children born out of wedlock or under dubious circumstances. In a second step, alternative care schemes in place for the protection of parentless children are examined and their potential to recreate a legal parent-child relationship is discussed. In addition to the countr y-specific analyses included in this book, three further contributions explore the subject matter from perspectives of premodern Sunni legal doctrine, premodern Shiite legal doctrine and the private international law regimes of contemporary Arab countries. Finally, a comparative analysis of the themes explored is presented in the synopsis at the end of this volume. The book is aimed at scholars in the fields of Muslim family law and comparative family law and is of high practical relevance to legal practitioners working in the area of international child law. Nadjma Yassari is Leader of the Research Group “Changes in God’s Law: An Inner-Islamic Comparison of Family and Succession Law” at the Max Planck Institute for Comparative and International Private Law while Lena-Maria Möller is a Senior Research Fellow at the Max Planck Institute and a member of the same Research Group. Book excerpt: The development of psychiatry in the Middle East, viewed through the history of one of the first modern mental hospitals in the region. ʿAṣfūriyyeh (formally, the Lebanon Hospital for the Insane) was founded by a Swiss Quaker missionary in 1896, one of the first modern psychiatric hospitals in the Middle East. It closed its doors in 1982, a victim of Lebanon's brutal fifteen-year civil war. In this book, Joelle Abi-Rached uses the rise and fall of ʿAṣfūriyyeh as a lens through which to examine the development of modern psychiatric theory and practice in the region as well as the sociopolitical history of modern Lebanon. Abi-Rached shows how ʿAṣfūriyyeh's role shifted from a missionary enterprise to a national institution with wide regional influence. She offers a gripping chronicle of patients' and staff members' experiences during the Lebanese Civil War and analyzes the hospital's distinctive nonsectarian philosophy. When ʿAṣfūriyyeh closed down, health in general and mental health in particular became more visibly “sectarianized”—monopolized by various religious and political actors. Once hailed for its progressive approach to mental illness and its cosmopolitanism, ʿAṣfūriyyeh became a stigmatizing term, a byword for madness and deviance, ultimately epitomizing a failed project of modernity. Reflecting on the afterlife of this and other medical institutions, especially those affected by war, Abi-Rached calls for a new “ethics of memory,” more attuned to our global yet increasingly fragmented, unstable, and violent present.

Book excerpt: The surprising similarities in the rise and fall of the Sunni Islamic and Roman Catholic empires in the face of the modern state Coping with Defeat presents a historical panorama of the Islamic and Catholic political-religious empires and exposes striking parallels in their relationship with the modern state. Drawing on interviews, site visits, and archival research in Turkey, North Africa, and Western Europe, Jonathan Laurence demonstrates how, over hundreds of years, both Sunni and Catholic authorities experienced three major shocks and displacements—religious reformation, the rise of the nation-state, and mass migration. As a result, Catholic institutions eventually accepted the state’s political jurisdiction and embraced transnational spiritual leadership as their central mission. Laurence reveals an analogous process unfolding across the Sunni Muslim world in the twenty-first century. Identifying institutional patterns before and after political collapse, Laurence shows how centralized religious communities relinquish power at different rates and times. Whereas early Christianity and Islam were characterized by missionary expansion, religious institutions forged in the modern era are primarily defensive in nature. They respond to the simple but overlooked imperative to adapt to political defeat while fighting off ideological challenges to their spiritual authority. Among Laurence’s findings is that the disestablishment of Islam—the doing away with Islamic affairs ministries in the Muslim world—would harm, not help with, reconciliation to the rule of law. Examining upheavals in geography, politics, and demography, Coping with Defeat considers how centralized religions make peace with the loss of prestige.
