Book excerpt: This publication aims to make the Venice Commission's work in the field of protection of minorities more available to the public. It includes, on the one hand, the Proposal for a European Convention on the protection of minorities, as a reply to the heartfelt need for protection of minorities at the European level. The proposal and its explanatory report appear in the first chapter of the publication. This publication includes, in addition, firstly the report on the protection of minorities at domestic law level which was drawn up within the framework of the Venice Commission and secondly the report concerning the special protection of which minorities can take advantage in States with a Federal or Regional structure. The report in question was established on the basis of replies provided by representatives of several European and non-European States to a questionnaire drawn up by the Commission; the questionnaire, together with the replies, appears in an Appendix to the report. Perusal of the replies given by representatives of different States to the same question allows for a rapid appraisal of the solutions adopted in national laws to identical problems of protection of minorities. The legacy of Apartheid in South Africa complicates this effort considerably. Henrard introduces a theoretical framework regarding how to accommodate minority protection in the most appropriate way and analyzes the respective contributions of individual rights, minority rights, and the right to self-determination. Subsequent chapters examine the case study of post-apartheid South Africa and attempt to investigate its constitutional development. Henrard finds that provisions within the 1996 Constitution do acknowledge an interrelation between these three important factors; however, implementation of minority protection policy is often quite a different matter. In seeking appropriate means of minority protection, this study stresses inclusionism, integration, and the essential right to identity and real equality. While Henrard reviews and discusses the entire democratic transformation process in South Africa, she cautions that, because current developments are characterized by their unsettled nature, major transformation and flux, analysis of the implementation phase can be only indicative. The apartheid history does not in itself inhibit progressive stances on this important issue. Still, despite the promising nature of the 1996 Constitution, the picture that emerges in terms of policy development aimed at minority protection is ambivalent.

Book excerpt: Convinced that education was one of the essential keys to the renewal and growth of their communities, revitalized Francophone organizations and leaders lobbied for constitutional entrenchment of official bilingualism and of a mandated Charter right to education in their own language, including the right to governance over their own schools and school boards. Having achieved their objectives in the 1982 Charter of Rights and Freedoms, Francophone provincial and national leaders learned the techniques of micro-constitutional politics to convince the Ontario, Alberta, and Manitoba provincial governments to implement full and unfettered school governance by and for Francophone minority communities. These communities received the backing of Canada's Supreme Court, which gave a collectivist and remedial interpretation to the Charter's official language minority education rights section 23. The Canadian government assisted the Francophone minority in two ways: it made funds available to Francophone organizations and parents via the Court Challenges program and it signed lucrative financial agreements with the provinces to help defray the additional costs of establishing French-language schools and school boards. While the Francophone minority communities were pursuing implementation of their section 23 Charter rights, they found themselves drawn into the mega-constitutional negotiations and ratification procedures surrounding the controversial Meech Lake Constitutional Accord, 1987-90, and the omnibus Charlottetown Consensus Report, 1990-92. During the Quebec/Provincial Round, their Charter rights remained intact when the Meech Lake Accord failed to obtain ratification. During the Canada Round, they managed to obtain recognition of their conception of a pan-Canadian cultural and linguistic duality which helped minimize the constitutional and political impact of the Quebec government's insistence upon a territorial conception of duality, that is, an asymmetrical Canada/Quebec federation. When Canadians rejected the Charlottetown deal, neither conception achieved formal constitutional recognition. Nevertheless, Canada's Francophone minority communities were regenerated by the intertwined developments of constitutional renewal and their winning of school governance. A new, vigorous Francophone pan-Canadian national community emerged, one capable of ensuring the survival of its constituents communities well into the twenty-first century.

Book excerpt: All over the world, in the most varied contexts, contemporary theatre is a rich source for increasing the visibility of communities generally perceived by others as minorities, or those who see themselves as such. Whether of a linguistic, ethnic, political, social, cultural or sexual nature, the claims of minorities enjoy a privileged medium in theatre. Perhaps it is because theatre itself is linked to the notions of centre and periphery, conformism and marginality, domination and subjugation – notions that minority theatre constantly examines by staging them – that it is so sensitive to the issues of troubled and conflicted identity and able to give them a universal resonance. Among the questions raised by this volume, is that of the relationship between the particular and the more general aims of this type of theatre. How is it possible to speak to everyone, or at least to the majority, when one is representing the voice of the few? Beyond such considerations, urgent critical examination of the function and aims of minority theatre is needed. To what kind of public is such drama addressed? Does it have an exemplary nature? How is it possible to avoid the pitfalls and the dead end of ghettoization? Certain types of audience-specific theatre are examined in this context, as, for example, theatre as therapy, theatre as an educational tool, and gay theatre. Particular attention is paid to the claims of minorities within culturally and economically dominant western countries. These are some of the avenues explored by this volume which aims to answer fundamental questions such as: What is minority theatre and why does theatre, a supposedly bourgeois, if not to say elitist, art form, have such affinity with the margins? What if, particularly in contemporary society, the theatre as a form, were merely playing out its fundamentally marginal status? The authors of these essays show how different forms of minority theatre can challenge cultural consensus and homogenization, while also aspiring to universality. They also address the central question of the place and status of apparently marginal forms of theatre in the context of globalization and in doing so re-examine theatre itself as a genre. Not only do they illustrate how minority theatre can challenge the dominant paradigms that govern society, but they also suggest their own more flexible and challenging frameworks for theatrical activity.

Should minority theatre increase its visibility in relation to the mainstream, or, on the contrary, remain on the margins and assert its specificity? This question is at the centre of French-Canadian experience, for example, but also applies to other postcolonial societies, in Europe and elsewhere. In order to maintain its cultural authenticity, should this type of theatre distinguish itself from a multiculturalism that runs the risk of political and social recuperation? If it is unable to resist the model proposed by globalization and widespread cultural dissemination, will it lose its legitimacy? Can, and should there be, a form of popular art at the service of the community? The term “minority” raises questions that will be examined by the articles collected in this volume. What is the definition of a minority? Does this term refer to experimental and avant-garde art forms as well as to ethno-cultural drama? Contemporary theatre is characterized by an aesthetics of hybridity—in what measure is this the case for theatre outside the mainstream? The exploration of this kind of theatre necessitates an examination of the very concept of theatre per se. Since the development of the electronic media as the privileged vector of culture, has not the theatrical genre itself become a minority art form? These are some of the pressing questions that this volume will try to address, thanks to a cross-cultural, multidisciplinary approach that aims to reveal the rich diversity of the field under study.
