Parce que sectorielle, la convergence des droits doit être bornée: le périmètre des matières et notions à inclure dans un instrument européen est à discuter particulièrement (Troisième partie). Enfin, si l'harmonisation ou l'uniformisation du droit européen a été impulsée par la réflexion doctrinale, son achèvement, par un effet de retour, conduira à penser et enseigner différemment le droit des obligations (Quatrième partie)."

Dans une perspective plus large, la question posée conduit à explorer et à analyser - au travers de l'exemple des règles d'UNIDROIT - les relations qui se nouent actuellement entre trois sphères normatives distinctes : la sphère nationale, la sphère régionale - qui est ici celle de l'Union européenne - et la sphère internationale. Les enjeux soulevés sont non seulement conceptuels, mais aussi normatifs et institutionnels. Le droit des contrats se révèle particulièrement propice à une telle analyse. L'intense production normative qu'il suscite rend les enjeux liés à l'interaction entre les normes décisifs, et permet corrélativement de mieux saisir la diversité des mécanismes de coordination susceptibles d'être mis en oeuvre tant à l'échelle régionale qu'à l'échelle internationale.
