Available in PDF, EPUB and Kindle. Book excerpt: In recent years, transnational private regulations (TPRs) have gained importance in the areas of business and human rights, particularly from a consumer point of view. However, some question whether TPRs are indeed suitable normative frameworks contributing to their signatory entities’ compliance with human rights standards and effective avoidance of human rights abuses. In response to this question, this book proposes an analytical concept of effective compliance. Based on the elements identified as crucial for achieving effective compliance, it conducts an in-depth analysis of how TPRs’ normative frameworks function in practice and identifies common patterns and challenges. Such inquiry is based on an interdisciplinary methodological approach between law and sociology, seeking not only to comprehend and assess how law is systematized in theoretical terms, but also to understand how it works on the ground. This allows identification of the lack of active and effective participation of vulnerable stakeholders in the discursive processes established and governed by TPRs, such as rule-making and conformity assessment processes, as the main challenge. Based on such evidence, the book addresses the possibilities of overcoming such challenges, proposing that to fully achieve TPRs’ potential from an effective compliance point of view, legal empowerment of vulnerable groups is essential. It concludes by providing key observations and suggestions that contribute to the use of TPRs as instruments in the struggle for rights of empowered vulnerable stakeholders. The book will be of interest to academics, researchers, and policy-makers working in the areas of international law, transnational law, sociology of law, and human rights law.

Some of these are considered global due to their internationally relevant subject matter, whilst others demonstrate the blurring of traditional legal categories in an age of accelerated cross-border movement. The study of the selected cases in their political, cultural, social and economic contexts sheds light on the contemporary transformation of law through its encounter with conflicting forms of normativity and the multiplication of potential fora.

Available in PDF, EPUB and Kindle. Book excerpt: In this book, leading international thinkers take up the demanding challenge to rethink our understanding of social justice at work and our means for achieving it – at a time when global forces are tearing the familiar fabric of our working lives and the laws regulating them. When fabric is torn we can see deeply into it, understand its structural weaknesses, and imagine alterations in the name of resilience and sustainability. Seizing that opportunity, the authoritative commentators examine the lessons revealed by the pandemic and other global shocks for our ideas about justice at work, and how to advance that cause in the world as we now find it. The chapters deliver critical re-assessments of our goals, explore our new challenges, and creatively re-imagine trajectories for progress on two global fronts - via international institutions and by a myriad of other transnational techniques. These forward-looking essays are in honour of Francis Maupain, whose international career and scholarly writing are inspiring models for those who, in a changing world, seize opportunities for creativity in the pursuit of global justice at work.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers new perspectives on global phenomena that play a major role in today’s society and deeply shape the actions of individuals, organizations and nations. In a complex and rapidly changing environment, decision-makers need to gain a better understanding of global phenomena to adapt and to anticipate the evolution of the global context. The authors—ten renowned international scholars of anthropology, economics, law, management and political science—propose an interdisciplinary and comparative approach to social sciences. They analyse how international phenomena, such as globalisation or transnationalisation, transform the disciplines of social sciences from an epistemological standpoint. Explaining what ‘global' means in difference disciplines, the authors analyse several global phenomena that characterise today’s international environment such as the circulation of norms and ideas, the linkages between war and globalization, corporate governance, and the impact of multinational enterprises on sustainable development and poverty reduction. Providing examples of analytical disciplinary approaches and guidelines for decision-makers in a fast-changing global context this book will be useful to scholars and students of anthropology, economics, law, management and political science as well as practitioners in the private and public sectors.

Available in PDF, EPUB and Kindle.

It is built around the creative and entrepreneurial power of the business firm and the new opportunities and challenges offered by science and technology, globalization and deregulation. Rather than focusing on tools, techniques and existing practices, it is the first to offer a conceptual and critical analysis of the new trend towards Corporate Social Responsibility. It argues that the legitimacy of the corporation will depend more and more on the contribution it wants to bring to our transition towards sustainable development.
