Book Synopsis Idea and Methods of Legal Research by : P. Ishwara Bhat
Download or read book Idea and Methods of Legal Research written by P. Ishwara Bhat and published by Oxford University Press. This book was released on 2019-09-05 with total page 551 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal research examines subject matter enshrouded in social circumstances in order to conceptualize theories and prepare a future course of action. This dynamic, inter-disciplinary, and labyrinthine character of legal research requires researchers to be fluid, eclectic, and analytical in their approach. Idea and Methods of Legal Research unearths how the thinking process is to be streamlined in research, how a theme is built on the basis of comprehensive and intensive study, and the paths through which notions of objectivity, feminism, ethics, and purposive character of knowledge are to be understood. The book first explains the meaning, evolution, and scope of legal research, and discusses objectivity and ethics in legal research. It engages with the requirements, advantages, and limits of various doctrinal and non-doctrinal methods and tools, and the points to be considered in selecting a suitable method or combination of methods. It highlights analytical, historical, philosophical, comparative, qualitative, and quantitative methods of legal research. The book then goes on to discuss the use of multi-method legal research, policy research, action research, and feminist legal research and finally, reflects on research-based critical legal writing, as opposed to client-related legal writing. This book, thus, is a comprehensive answer to key questions one faces in legal research.

Book Synopsis Methodologies of Legal Research by : Mark Van Hoecke
Download or read book Methodologies of Legal Research written by Mark Van Hoecke and published by Bloomsbury Publishing. This book was released on 2011-02-28 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: Until quite recently questions about methodology in legal research have been largely confined to understanding the role of doctrinal research as a scholarly discipline. In turn this has involved asking questions not only about coverage but, fundamentally, questions about the identity of the discipline. Is it (mainly) descriptive, hermeneutical, or normative? Should it also be explanatory? Legal scholarship has been torn between, on the one hand, grasping the expanding reality of law and its context, and, on the other, reducing this complex whole to manageable proportions. The purely internal analysis of a legal system, isolated from any societal context, remains an option, and is still seen in the approach of the French academy, but as law aims at ordering society and influencing human behaviour, this approach is felt by many scholars to be insufficient. Consequently many attempts have been made to conceive legal research differently. Social scientific and comparative approaches have proven fruitful. However, does the introduction of other approaches leave merely a residue of 'legal doctrine', to which pockets of social sciences can be added, or should legal doctrine be merged with the social sciences? What would such a broad interdisciplinary field look like and what would its methods be? This book is an attempt to answer some of these questions.

Book Synopsis Injury Illustrated by : R. Annie Gough
Download or read book Injury Illustrated written by R. Annie Gough and published by CRC Press. This book was released on 2020-10-29 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: The best storytellers and presenters know that a picture is worth a thousand words. Pictures simplify stories. They make stories memorable. They clarify complex concepts and they educate the audience in the easiest way. That is why attorneys work with artists—medical illustrators, to be exact. Injury Illustrated is the first book of its kind. It is the essential guide on medical illustrations used in the legal context. This book examines the creation of visual graphics known as demonstrative exhibits. These exhibits provide an understanding of traumatic injuries, surgeries, and radiology studies for the jury, judges, adjustors, mediators, and the attorneys. These chapters describe how to tell a clear story about gross anatomy, medical malpractice, and/or death investigation in court by using medical images. While medical illustration and injury law are very different professions, illustrators are the ideal partners for lawyers when solving problems and preparing for litigation. Divided into five sections, this book details who medical illustrators are, how they are educated in medicine, the skills and services they can provide to trial lawyers, and the countless benefits resulting from record review and case preparation. Find techniques to best use medical images during all stages of litigation Learn how graphic exhibits engage a jury and empower justice Understand why attorneys win more cases by collaborating with medical illustrators All readers will learn about this unique career and the attorney-illustrator relationship. More specifically, attorneys, artists, animators, law students, medical students, forensic scientists, and medical experts will understand how demonstrative exhibits assist legal proceedings in forensic matters and civil lawsuits. Warning; these images will be graphic and the cases at times will be catastrophic.

Book Synopsis Thinking Like a Lawyer by : Sarah E. Redfield
Download or read book Thinking Like a Lawyer written by Sarah E. Redfield and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The day-to-day lives of educators are increasingly bound by the law. It is essential that educators understand the sources and roles of law in order to act appropriately and to avoid difficult and litigious situations. This book provides a bridge between the legal professional and the education professional, offering an introduction to legal analysis. Since the first edition of this book, the law's role in schools has continued to expand. New problems call for new legal and policy solutions. The second edition focuses on school search cases as illustrations and brings them forward to today's concerns about searching cell phones, off campus activities, and even sexting. Written by a law professor who has long worked with both educators and law students, Redfield's book introduces the essential concepts of thinking like a lawyer. Thinking Like a Lawyer uses narrative, actual court cases, study tips, research methodologies, and an extensive glossary illustrated with education law examples to remove the mystique of reading about law. It also allows those who need to know the law, but are not necessarily lawyers, to move comfortably in this realm. The book is useful for individual readers or for classes in education law and administration.
Book Synopsis Research Handbook in Data Science and Law by : Vanessa Mak
Download or read book Research Handbook in Data Science and Law written by Vanessa Mak and published by Edward Elgar Publishing. This book was released on 2018-12-28 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: The use of data in society has seen an exponential growth in recent years. Data science, the field of research concerned with understanding and analyzing data, aims to find ways to operationalize data so that it can be beneficially used in society, for example in health applications, urban governance or smart household devices. The legal questions that accompany the rise of new, data-driven technologies however are underexplored. This book is the first volume that seeks to map the legal implications of the emergence of data science. It discusses the possibilities and limitations imposed by the current legal framework, considers whether regulation is needed to respond to problems raised by data science, and which ethical problems occur in relation to the use of data. It also considers the emergence of Data Science and Law as a new legal discipline.
