Book excerpt: Technological advances strongly influence developments in international telecommunications services. This book illustrates how international institutional and regulatory frameworks implement technological advances in the field of telecommunications. These frameworks canalize technology on the one hand and guide legal implementation of the actual international connections on the other. International telecommunications links are implemented by means of geostationary satellite or through submarine cables. The regulations and organizations dealing with satellite connections differ significantly from international regulations and organizations in the field of submarine cables. In Legal Aspects of Implementing International Telecommunication Links the concepts of `allocation' and `interconnection' are used to bridge the gap between these two different domains. Following a characterization and discussion of these concepts, The actual legal implementation of both types of connections is described in detail.

Book excerpt: This volume discusses various institutional, legal and operational aspects related to the provision of air navigation services, taking particular consideration of the current implementation of a new generation of communications, navigation and surveillance systems for future air traffic management (CNS/ATM). The primary intent is to critically review the current mechanisms for international co-operation in this field. Particularly in Europe, many efforts have been undertaken to enhance air traffic management by harmonization and integration of national developments but many parties claim that these are still insufficient and the processes are still dominated by the individual States. Following a short description of the historical developments, the global framework of cooperation established through ICAO is described, supplemented with a description of some multilateral organizations active in the field of air traffic management on a regional basis. The basic technological and operational changes envisaged with the implementation of the Future Air Navigation Systems (FANS) are described and, based on these, related institutional and legal aspects are discussed. Particular emphasis is given to developments in Europe, where during the last four decades several initiatives for enhancing the cooperation of States could not overcome the fragmentation of the airspace. The decisions of February 1997 of the ECAC Ministers of Transport on an Institutional Strategy are reflected. One chapter is devoted to questions of liability in air traffic management which are of particular importance with regard to international cooperation.

Available in PDF, EPUB and Kindle. Book excerpt: This book is neither a historical treatise on the genesis and development of space law, nor a survey of the corpus, nor even a work of legal makebelieve, but simply an essay pursuing a line of enquiry opened up by the members of the European Centre for Space Law. It sets out to chart future trends in the light of the emergence of space law as a branch of international law and of the development of space activities themselves (new activities, new players, interpenetration of space law and national laws), a branch in which the rules and forms of international cooperation acquire a new dimension, transcending the concept of `global' law. It is essentially prompted by a deep aspiration to see a rebirth - a revival - of that law.

The value of maritime, aviation, and general transport analogies and law is considered. The book then considers the proper parties, forums, law, and precedents available to resolve space transport disputes. This book is as much about what space transport law will be as what it is. It will interest legislators as well as lawyers. It will assist space transport participants to structure their agreements and resolve their disputes. The cases described will assist insurers in underwriting space risks and venture capitalists in hedging their bets. For students of law, it will extend conventional principles to unconventional situations.

Book excerpt: Near-earth space, which extends to geosynchronous orbits where satellites remain faithfully over a fixed spot on the ground, does not lend itself to romantic fantasies of science fiction. It is a working place from which services can be delivered with ease and efficiency. Meteorology, seismic and crop-yield predictions, environmental monitoring, communications of all sorts, guidance and navigation, medical and educational services, treaty verification and photographic reconnaissance, news-gathering, scientific observation across the entire electromagnetic spectrum, prospecting, remote sensing, and monitoring of human activities are all in a day's work for near-earth space. Global cellular telephony, only a few years ago the exclusive privilege of comic-book heroes, is becoming a space-based commonplace. Planes that land in fog and cars that find their way in the labyrinthine streets of Tokyo guided from space are beyond a near horizon. Space is delivering its promise. This volume describes many of these activities and their prospects for changing the way we live, communicate, and travel on this Earth.

Book excerpt: Neither rational choice theory, with its emphasis on interest calculation, nor sociological institutionalist theory, with its emphasis on identity-defined rule following, indicates how governments determine which of their multiple interests or identities are at stake in a particular situation or how they develop mutual comprehension of each other's goals. International Regimes for the Final Frontier addresses these gaps by tracing how governments approach an unfamiliar issue—in this case, international agreements regulating human activity in outer space between 1958 and 1988—and examines three ways situation definitions channel governments' approaches to issues or problems.
