Book excerpt: Par rapport à l'époque du GATT, le système de règlement des différends de l'OMC a considérablement évolué dans le sens d'un renforcement juridique et d'une relative institutionnalisation qui ont contribué à le rendre plus crédible auprès des pays en développement. La croissance régulière de leurs plaintes devant l'ORD est en soi une démonstration de cette confiance accrue. Pourtant cette implication ne concerne pas tous les pays en développement. L'apport modeste du régime spécial et différencié, le manque de capacité et la crainte de représailles politiques ou commerciales expliquent l'absence ou la faible participation de nombre d'entre eux. Par ailleurs, avec la pratique des activités de règlement des différends depuis une dizaine d'années, de nouveaux enjeux sont apparus. Les interprétations ambigües, à voir controversées peuvent toucher directement les intérêts des pays en développement. Tout cela justifie la nécessité de continuer à réformer le système en place. les pays en développement ont montré leur volonté et leur attitude active en proposant plusieurs propositions à l'occasion du Mémorandum d'accord. Pourtant, vu l'avenir flou de ce processus, il vaut mieux qu'ils mobilisent leurs ressources juridiques afin d'obtenir un meilleur accès au système de règlement des différends pour mieux se défendre dans le système commercial multilatéral.

The WTO dispute settlement system has created a sophisticated set of procedures designed with the sole purpose of dealing with all disagreements that can arise between the parties during the implementation process. The very existence of these procedures, and the manner in which the adjudicative bodies accomplish their task, give evidence of the fact that compliance with judgments in the international legal order does not inevitably lie outside the realm of the law. The WTO system thereby expresses but also fulfills a strong ambition, unique when considered through the lens of international law: strengthening the rule of law by vesting the adjudicative bodies with the task of supervising, reviewing, and ultimately contributing to inducing and enforcing compliance with their own judgments.
