Book excerpt: Pour bien saisir cette étude comparative de l'assistance maritime en droit français et marocain, il est apparu nécessaire de repartir les questions en deux grandes parties. La première est consacrée à l'assistance maritime du point de vue des faits qui la constituent. C'est ainsi que nous avons essaye de donner une définition de l'assistance maritime pour en déduire tous les effets et la distinguer des autres institutions voisines, à savoir le sauvetage et le remorquage. Nous avons ensuite abordé l’étude de l'obligation d'assistance afin de saisir les différentes formes et les sanctions de cette obligation. Par ailleurs, nous avons repris le problème de définition des engins qui peuvent recevoir ou doivent donner une assistance, selon leur nature aquatique, et envisage la question de l'assistance aux personnes. En sachant que le secours ne peut être qualifié d'assistance maritime qu'avec certaines conditions, nous avons parlé des dangers du navire assisté, de l’aléa des opérations, de l'obtention du résultat utile et enfin de l'acceptation du secours par le navire assisté. La seconde partie est consacrée à la rémunération de l'assistance. Après avoir envisagé la nature juridique de cette rémunération pour arriver à conclure qu'elle est une institution spéciale du droit maritime, nous avons parlé des divers procédés pour fixer la rémunération à savoir la fixation par contrat, par arbitrage ou par le tribunal. Nous avons alors envisagé les relations qui existent entre les parties, ainsi que la question des avaries communes et du rôle des assurances. Un chapitre est consacré aux problèmes de procédure (compétence, conflits de lois) et aux garanties de paiement. Enfin, en fonction de l'importance pratique de ces questions, il a semblé nécessaire d'envisager le problème de la responsabilité dans le cas de pollution par les hydrocarbures dans le cadre de l'assistance.

A l’époque de son élaboration, la loi maritime marocaine apparaît comme un texte solide et complet. Or, depuis 1919, une grande mutation s'est opérée dans le secteur des transports maritimes. L'importance des cargaisons transportées par mer, le développement des échanges commerciaux ont donné naissance à des entreprises de manutention qui accomplissent certaines opérations qui sont le préalable ou la suite nécessaire du transport maritime. Quel est le régime juridique de l'intervention de ces entreprises et quels sont les liens de droit qu'elles entreprennent avec le chargeur ou le destinataire et le transporteur ? Le droit français d'avant 1966, comme la législation marocaine de 1919, réglementent les seuls rapports du transporteur et du destinataire, ne donnent aucune solution à cet épineux problème. Le Maroc est à la veille d'une réforme de la législation maritime qui, à l'instar de la loi française de 1966, a réglé les limites spatiales du contrat de transport maritime. De même, la future législation maritime a résolu le problème du titulaire de l'action en responsabilité contractuelle contre l'entrepreneur de manutention et le régime juridique applicable à cette action. Sur ce point important, le projet de code maritime marocain, suit de très près la loi de 1966 puisqu'il supprime la disparité qui existait auparavant. Il ôte tout intérêt à l'action directe du destinataire contre l'acconier car, le statut juridique de ce dernier est aligne sur celui du transporteur maritime.

Book excerpt: Whether or not a certain norm is legally binding upon international actors may often depend on whether or not the instrument which contains the norm is to be regarded as a treaty. In this study, the author argues that instruments which contain commitments are, "ex" "hypothesi," treaties. In doing so, he challenges popular notions proclaiming the existence of morally and politically binding agreements and so-called soft law'. Such notions, Klabbers argues, are internally inconsistent and founded upon untenable presumptions. Moreover, they find little support in the pertinent decisions of municipal and international courts and tribunals. The book addresses issues of importance not only for academics working in international law, constitutional law and political science, but also for practitioners involved in the making, implementation and enforcement of international agreements.
