Pour que les citoyens puissent bénéficier des mêmes droits sur l'ensemble du territoire national, ils doivent pouvoir s'adresser à des institutions identiques d'un territoire à l'autre. La décentralisation s'est bâtie autour d'un droit étroitement lié à l'organisation de l'Etat unitaire et basé sur les principes d'égalité, d'unité et d'indivisibilité. Mais depuis 2003, nous pouvons observer l'émergence d'un mouvement porteur d'une réelle différenciation territoriale, cette dernière pouvant être entendue comme la prise en compte d'un droit différent d'un territoire à l'autre. Par une approche organique et matérielle et à partir d'une vision chronologique, cet ouvrage analyse les évolutions du droit de la décentralisation. Nous observons ainsi une réelle complexification de celui-ci. Ce phénomène engendre notamment des ruptures juridiques avec les principes d'égalité entre collectivités territoriales et d'unité des catégories de collectivités. Les bouleversements observés et les réformes futures envisagées laissent entrevoir de nouvelles interrogations sur la notion même de décentralisation.
