Si chacun connaît à propos du contrat la notion d'équivalence des prestations, celle-ci est la plupart du temps évacuée par le juriste à la lecture de l'expression contenue dans l'article 1104 du Code civil qui regarde comme équivalent ce que les parties se sont engagées à donner ou à faire dans le contrat commutatif. Plus encore, la période des forces en présence qui mène inéluctablement au déséquilibre contractuel, mettant en péril toute possibilité d'affirmation d'un principe d'égalité dans le droit civil des contrats. Pourtant, le combat contre les inégalités a bien pour but premier le rétablissement d'une égalité souhaitée et souhaitable. L'action ne peut donc s'analyser qu'au regard d'un principe d'égalité soit préexistant, soit interprété comme un but à atteindre. Au travers de l'étude des différentes institutions contractuelles, tentative est menée de trouver un contour précis à ce principe d'égalité. Le raisonnement est déroulé progressivement, tentant de s'abstraire de tout clivage, empruntant tant au domaine classique de la théorie générale des obligations qu'au droit public et à l'histoire du droit. La définition de ce que doit être le principe d'égalité dans le droit civil des contrats n'aurait par ailleurs pas pu être rigoureusement dessinée sans une étude approfondie d'une notion voisine de l'égalité, si souvent galvaudée mais au fond si peu connue : l'équité.
