As such, it can be found in international human rights treaties, in constitutions and in national legislation. In this book the principle of equality is analysed from different angles, bearing in mind the South African and Belgian experiences in this area. Firstly, a general overview is given of the different sources of human rights law in the Belgian and South African legal system, the relation between international and national law, the direct applicability and third party-applicability of rights and freedoms in the legal order(s), and the implementation mechanisms available both in Belgium and South Africa. Secondly, the principle of equality, as found in the Belgian Constitution, in the European Convention on Human Rights and in the South African Constitution, and the South African Antidiscrimination Bill are analyzed. Finally, the principle of equality is being studied from a thematic perspective, i.e. with regard to the use of languages and from a gender perspective. The book is concluded with a contribution on the access to medical and health care in South Africa.

Book excerpt: The introduction by the Amsterdam Treaty of the flexibility clauses, authorising a majority of Member States to cooperate more closely in areas covered by the Treaties, has been received with mixed feelings. Flexibility is by no means a new phenomenon in the EU's development. It has been on the Community's agenda already since the 1970s. The Single European Act introduced several provisions allowing for flexible approaches to the single market, whilst the Maastricht Treaty launched a differentiated approach to the EMU and social policy. In addition to these forms of differentiation in primary Community law, for many years there has also been a number of quite important, though less visible, forms of differentiation in secondary Community law. This book aims to link both levels of differentiation and seeks to unveil the many faces of differentiation in EU law. It analyses whether, and to which extent, there is a shift in European integration from a system of unity and uniformity to one of flexibility and differentiation. A first series of contributions to the book analyse a number of exemplary policy fields (EMU, social policy, environment, free movement of persons, justice and home affairs) in order to identify their degree of differentiation. A second set of contributions examine various 'horizontal' institutional matters of cross-sectoral importance. These two main parts are framed by introductory articles on the development of flexibility and by contributions drawing on the constitutional limits to differentiation. Book excerpt: In order to further scientific knowledge of human rights, the Council of Europe holds high-level meetings, such as colloquies, round tables and seminars. Every five years an important Colloquy on the European Convention on Human Rights takes place in a town of a member State. The Eighth International Colloquy on the European Convention on Human Rights, organised by the Secretariat General of the Council of Europe in collaboration with the Ministry of Justice of Hungary and the Hungarian Institute for Legal and Administrative Sciences, was held in Budapest from 20 to 23 September 1995. This volume contains the Proceedings of the Budapest Colloquy, which covered the following themes: The European Convention on Human Rights and cultural rights 1st session: Cultural rights: universal, indivisible, and legally enforceable rights; 2nd session: Cultural rights and the management of particular situations to ensure democratic security in Europe; The European Convention on Human Rights in the new architecture of Europe 3rd session: Effects on the European Convention on Human Rights of the enlargement of the number of Contracting Parties; 4th session: Implementation of the reform of the European Convention on Human Rights control machinery.Afin de promouvoir le progrès des connaissances scientifiques en matières de droits de l'homme, le Conseil de l'Europe tient des réunions au plus haut niveau, sous forme de colloques, tables rondes et séminaires. Tous les cinq ans, un important colloque sur la Convention européenne des droits de l'homme est organisé dans une ville d'un pays membre. Le huitième Colloque international sur la Convention européenne des droits de l'homme, organisé par le Secrétariat Général du Conseil de l'Europe en collaboration avec le Ministère de la Justice et l'Institut des Sciences juridiques et administratives de Hongrie, a eu lieu à Budapest du 20 au 23 septembre 1995. La présente publication contient les actes du huitième Colloque. Le Colloque portait sur les thèmes suivants: La Convention européenne des droits de l'homme et les droits culturels 1e session: Les droits culturels: droits individuels universels, indivisibles, et justiciables; 2e session: Les droits culturels et le traitement de situations particulières en vue d'assurer la sécurité démocratique en Europe; La Convention européenne des droits de l'homme dans la nouvelle architecture de l'Europe 3e session: Les effets de l'accroissement du nombre des Parties contractantes sur la Convention européenne des droits de l'homme; 4e session: La mise en oeuvre de la rérme du mécanisme de contrôle de la Convention européenne des droits de l'homme.

Book excerpt: Au courant de l'annee rg6r le mecanisme de protection des droits de l'homme institue par la Convention a, pour la premiere fois, fonctionne dans son integralite. La Commission, la Cour et le Comite des Ministres ont, en effet, exerce les fonctions que leur assigne la Convention. Les juristes suivent, depuis 1955 deja, la jurisprudence de la Commission qui apporte une importante contribution au droit international general. L'annee rg6r leur fournit une plus ample matiere avec le premier arret sur le fond jamais rendu dans le domaine des droits de l'homme par un tribunal international. C'est le rer juillet rg6r que la Cour europeenne des Droits de l'Homme a prononce son arret dans l'affaire Lawless, mettant ainsi fin au litige introduit devant la Commission par un particulier contre son propre gouvernement. A cet arret vient s'ajouter la decision prise dans l'affaire Nielsen par le Comite des Ministres du Conseil de l'Europe le 25 octobre rg6r.
