Cependant, la spécificité du littoral, espace rare et convoité, impose une protection accrue du littoral au détriment d'un aménagement axé essentiellement sur la rentabilité des infrastructures touristiques. En outre, la volonté constante de maximiser les profits sur les propriétés publiques est un objectif commun que les personnes publiques et les occupants veulent atteindre. C'est pourquoi, on assiste à une banalisation du droit administratif par rapport aux règles du droit privé sous l'effet conjugué des règles de concurrence et du droit communautaire. Cette thèse démontre que la recherche de la rentabilité des personnes publiques et privées doit se conformer essentiellement au respect des règles protection de l'environnement et de concurrence sur les ports de plaisance.
