C'est pourquoi, on assiste à une banalisation du droit administratif par rapport aux règles du droit privé sous l'effet conjugué des règles de concurrence et du droit communautaire. Cette thèse démontre que la recherche de la rentabilité des personnes publiques et privées doit se conformer essentiellement au respect des règles protection de l'environnement et de concurrence sur les ports de plaisance.
