Au vu des conséquences désastreuses que peuvent avoir dans le service ou sur l'opinio popularis certaines dérives de l'expression, la détermination de la frontière entre protection des droits fondamentaux des fonctionnaires et sauvegarde des " intérêts légitimes des Communautés " est des plus délicate. Pour périlleuse qu'elle soit, cette épreuve d'équilibrisme semble avoir été parfaitement surmontée par le juge et le législateur qui ont su instaurer un régime combinant subtilement traditions juridiques nationales, droit européen des droits de l'homme et caractéristiques applicables aux fonctionnaires internationaux. Les " expressions libres " du fonctionnaire, celles qui peuvent entrer en contradiction avec la politique officielle des Communautés, de même que celles qui en sont détachables, sont garanties par des sources relativement solides. De même, la liberté d'expression ne peut être restreinte qu'en cas d'atteinte réelle aux " intérêts légitimes des Communautés ". Un strict respect des obligations de loyauté et d'impartialité suppose en effet que le fonctionnaire, devant préserver à tout prix le lien de confiance l'unissant à son institution, modère en toutes circonstances l'expression de ses opinions. Quoi de plus légitime...Servir les Communautés européennes confère une dignité particulière au fonctionnaire et requiert de sa part, si ce n'est une adhésion idéologique totale, une conscience que les opinions nuisibles au processus d'intégration communautaire doivent être tues. Cette contrainte exercée sur la liberté d'expression est d'ailleurs assurément légitime dans son exercice. En effet, malgré un manque certain de modélisation du régime, le fonctionnaire, qui jouit d'un " droit au juge " parfaitement efficace, est relativement protégé contre l'éventuel arbitraire de l'administration.

Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.

This book examines the convergence between its two constituent systems: the damages liability of the EU and that of its Member States for failing to comply with EU rules. Member State liability, based as it is on the Francovich case (1991) and Brasserie du Pêcheur and Factortame (1996) judgments of the European Court of Justice (ECJ) is well established. But it is yet to be closely scrutinised by reference to the detailed rules on the liability of the European Union. The focus of the book is on the two key legal criteria that are common to both systems, namely the grant of rights to individuals by EU law and the notion of sufficiently serious breach of such rights. The analysis concentrates on developments in the case law of the ECJ and the General Court since the Bergaderm judgment (2000), which consolidated the convergence of the two liability systems that was first indicated in Brasserie du Pêcheur and Factortame. These two criteria are set side by side to evaluate the extent, in real terms, of the convergence of Member State and EU institutional damages liability, and to determine the extent to which one has influenced the other. This book shows that although full convergence between the two liability systems is not likely, each stream of case law should look to the other more actively as this important element of EU remedial law develops. Convergence in EU law public liability is supported by developments in adjacent areas, most notably European tort law and European administrative law. This study also illustrates how convergence in the EU liability systems to date has had spill-over effects into national public liability law.

Book excerpt: The Treaty of Rome makes no mention of the Mediterranean basin as such, inc1udes not a single provision for the defining of specific relations with that region as a whole. There are only, as a hang-over from the French and Italian colonialist past, certain Dec1arations, in the Appendices, regard ing a possible association of Tunis, Morocco, Libya with the new under taking. And, of course, there is Artic1e 113 prescribing, at the end of the Community's transition period, the common trade policy - plus the Artic1e (238) giving blanket authorisation for association agreements. These legal prescriptions were duly implemented in the Association Agreements with Greece (1961) and Turkey (1963) and have supplied the basis for bilateral instruments in respect of other Mediterranean lands - ad hoc, pragmatic ar rangements. In the circumstances the Community could scarcely have proceeded otherwise. Yet the outlines of a European economic policy with regard to the countries of the Mediterranean basin were there from the beginning -limited, however, over the years by the internal development of the Community itself. One is reminded in this connection of sundry invoca tions by European and Mediterranean personalities and members of the European Commission - and, specifically, of a Memorandum presented by Italy to the Council of Ministers in 1964.
