Pour cette raison, certains pays européens ont adopté de nouvelles lois et de nouvelles politiques pour attirer les ouvriers étrangers hautement ou moyennement qualifiés. Cependant, les nouvelles mesures peuvent mettre en danger certains acquis dans ce domaine et peuvent ne pas être en accord avec les normes du Conseil de l'Europe visant à garantir les droits des travailleurs migrants, tels que la Charte sociale européenne et la Convention européenne relative au statut juridique du travailleur migrant. Cette étude se concentre sur les règles concernant le statut juridique des principales catégories de travailleurs migrants admis aux fins d'un emploi dans certains Etats membres du Conseil de l'Europe. L'étude examine la question essentielle de savoir si ces règles nationales sont conçues de manière à aider les migrants à s'intégrer dans le pays d'accueil, en leur garantissant un statut de résidence stable et l'accès aux droits sociaux, ou si elles découragent ou même empêchent une telle intégration.

The vast majority of these are countries of immigration, which means they face specific challenges in terms of managing migratory flows that are increasingly linked with climate change and scarce natural resources worldwide, and they need to find viable ways to integrate humanitarian migration. Unlike so many recent publications in the field of international migration law, this book brings together reports on diverse countries that are rarely regarded as part of one and the same picture, depicting globalized migration in the contemporary era that to a large extent challenges state sovereignty. The contributions delineate the legal regimes that individual states are continually developing and modifying with a view to managing and controlling access of individual persons to their respective territories. They also show how the restrictive measures that states resort to in the event of failure to manage migration could have a lasting legal impact. The General Report preceding the country reports provides a comparative overview of the national reports, and is divided into two parts. The first, more technical in nature, addresses the classic questions relating to admission to and residence in a country. The second, more reflective section, examines the relationship between laws and migration in a wider and multidisciplinary perspective. To allow a robust comparison, the country reports all follow a similarly wide-ranging structure; to the extent possible, they also cover the historical, sociological and demographic factors that help explain legal regimes and migratory flows in each country. Book excerpt: Migrants in irregular situations are confronted with dangerous circumstances during their journeys toward Western countries and upon their arrival in those countries of destination. While continuously disputed by social and political forces, migrants and their children continue to live an isolated life in our communities, facing discrimination, abuse, and labour exploitation. Courts and tribunals in our societies try to make sense of this human mobility by sorting out basic human rights and economic privileges in a way which is too revolutionary for conservative parties and too slow and unfair for human rights activists. This book focuses on the issue of human rights protection of migrants in irregular situations. The concept of protection does not refer to a humanitarian definition of aid and intervention on behalf of the victims of migration. Protection here means official recognition by the State and by the law of migrants in irregular situations. It also means recognition of the human rights of migrants, recognition of the migrant as a political actor, and from there, political inclusion and politicization of the migrant. Discussions in international forums are dominated by Westphalian visions of the world, and no change can be envisioned in the near future with this kind of discourse. In a highly individualized and fragmented world, an undocumented migrants destiny is instead decided on a case-by-case basis in our national courts, and today the most effort is put into advocacy and legal representation.
