Dans le but d'établir un fondement juridique de ce droit, nous analysons, au cours de la première partie, quelles sont les nouvelles orientations humanitaires du droit de l'espace, la notion de patrimoine commun de l'humanité, la règle de la finalité humaine établie par l'article 1er du traité de 1967 et la tendance à considérer l'humanité toute entière en tant que sujet de droit de l'espace. Dans notre deuxième partie, nous évaluons la mise en application dudit droit. Au niveau national : par l'analyse des politiques spatiales des Etats-Unis et de l'Union Soviétique. Au niveau international : par l'analyse des activités des organisations internationales universelles et régionales. A la lumière de cette étude, nous pouvons affirmer dès à présent que la revendication de ce droit des Etats non-possédants, selon la réglementation juridique des activités spatiales, est justifiée. D'autre part, l'entrave de sa mise en application est constituée non seulement par la politique égoïste des puissances spatiales, mais aussi par l'incapacité de la structure institutionnelle internationale de répondre à ses exigences. Enfin, nous proposons l'établissement d'une Agence Spatiale Internationale.
