Cet ouvrage se concentre sur l'analyse de ce régime innovant, à la lumière de la jurisprudence et de la doctrine antérieure, des travaux préparatoires et des premières tendances dans la pratique.00Cette innovation du droit des biens permet la mise en place d'une structure immobilière longtemps réclamée par la pratique : la propriété en volume. Il s'agit de la possibilité de céder ou d'acquérir la propriété d'un volume ou d'une partie d'un bâtiment (un étage de bureaux, la partie résidentielle au-dessus d'un centre commercial, etc.) sans acquérir la propriété du terrain ni mettre en place un régime de copropriété. De façon remarquable, cette opération permet ainsi à l'acquéreur d'éviter les contraintes d'un acte de base et le coût financier et fiscal de l'acquisition du terrain. Elle permet aussi au vendeur qui le souhaite (par exemple un pouvoir public) de conserver un certain contrôle foncier sur le bien cédé. ll s'agit ainsi d'un nouvel outil flexible particulièrement utile pour le secteur immobilier.
