Plusieurs paramètres, telle la complexité de certaines chaînes de causalité de dommages, peuvent cependant rendre le contentieux indemnitaire public structurellement inadéquat pour la prise en charge de quelques victimes spécifiques. Lorsqu'il est amené à apprécier le bien fondé d'une action en responsabilité administrative, le juge est fréquemment confronté au dilemme suivant: soit sauvegarder les principes de la responsabilité, en identifiant un événement directement à l'origine du dommage et en l'imputant clairement à l'activité de puissance publique; soit tordre ceux-ci, et assurer l'effectivité de la réparation. Malgré cette dimension sociale et collective de la responsabilité administrative, les fonds d'indemnisation ne doivent pas être confondus avec elle. Les principes appelés par les mécanismes législatifs spéciaux pour accorder la compensation semblent effectivement se dissocier absolument de l'imputation d'un fait dommageable à la puissance publique. Ils reposent au contraire sur des considérations de solidarité et de fraternité. L'objet de la thèse est d'analyser le droit de la responsabilité administrative au travers du prisme de la création, de l'existence et du développement des fonds d'indemnisation. Précisément, il s'agit de rechercher comment les organismes se positionnent par rapport à lui, et ce que leur existence apporte et peut apporter à ce pan du droit. L'extension contemporaine dse accidents couverts par les fonds semble finalement vouloir répondre à cette double problématique : puisque les contours de la responsabilité s'évaporent, il convient de juguler le phénomène ; puisque la responsabilité est en tout état de cause fondamentalement limitée dans sa fonction de réparation des préjudices, il est nécessaire de pallier ces insuffisances. A cet égard, la place des fonds d'indemnisation vis-à-vis du droit de la responsabilité peut être ordonnée de la façon suivante : d'une part, les mécanismes suppléent le droit de la responsabilité administrative, en ce qu'ils permettent la compensation de certains troubles là où le contentieux indemnitaire public est inefficace ou inadapté. Ensuite, et par conséquent, ils corrigent le droit de la responsabilité administrative en ce qu'ils le font revenir, ou pourraient le faire revenir, à certaines de ses règles initiales.

This book examines the convergence between its two constituent systems: the damages liability of the EU and that of its Member States for failing to comply with EU rules. Member State liability, based as it is on the Francovich case (1991) and Brasserie du Pêcheur and Factortame (1996) judgments of the European Court of Justice (ECJ) is well established. But it is yet to be closely scrutinised by reference to the detailed rules on the liability of the European Union. The focus of the book is on the two key legal criteria that are common to both systems, namely the grant of rights to individuals by EU law and the notion of sufficiently serious breach of such rights. The analysis concentrates on developments in the case law of the ECJ and the General Court since the Bergaderm judgment (2000), which consolidated the convergence of the two liability systems that was first indicated in Brasserie du Pêcheur and Factortame. These two criteria are set side by side to evaluate the extent, in real terms, of the convergence of Member State and EU institutional damages liability, and to determine the extent to which one has influenced the other. This book shows that although full convergence between the two liability systems is not likely, each stream of case law should look to the other more actively as this important element of EU remedial law develops. Convergence in EU law public liability is supported by developments in adjacent areas, most notably European tort law and European administrative law. This study also illustrates how convergence in the EU liability systems to date has had spill-over effects into national public liability law.
