Son approche ayant évolué dans le temps, les deux parties de la recherche correspondent aux deux périodes de la réglementation. L'introduction détermine et définit les compétences communautaires dans ce secteur d’activités. L'approche communautaire a été conjoncturelle dans une premier phase, entre 1974 et 1986. La réglementation consistait alors dans une recherche de solutions aux problèmes ponctuels rencontres par les marines marchandes européennes. Ainsi, la Communauté est confrontée à l’évolution de la répartition de la flotte mondiale. Cela l’amène à prendre en compte les désirs des pays en développement et à organiser la surveillance des trafics de certains pays tiers dont la concurrence, jugée déloyale, affaiblit considérablement les armateurs communautaires. Par ailleurs, elle est confrontée à la question de la sécurité maritime lorsque que survient le naufrage de l'Amoco-Cadiz au large des cotes françaises. De cet événement naîtra un embryon de réglementation communautaire actuellement développée dans le cadre d'une "politique commune de la sécurité maritime". Dans une seconde phase, entre 1986 et aujourd'hui, la Communauté entreprend de soumettre les transports maritimes à la philosophie libérale du Traité de Rome. Elle commence avec l'adoption de deux règlements (CEE) du Conseil du 22 décembre 1986 qui appliquent à ce secteur le principe de la libre prestation de services et les règles de concurrence. Cette démarche s'inscrit dans le cadre d'une volonté d’équilibre dans la libéralisation. En effet, en contrepartie de ces règlements, deux autres règlements (CEE) du conseil du 22 décembre 1986 peuvent être qualifiés d'instruments de défense des flottes. L’équilibre ainsi trouve n'a pas été effectivement réalisé et la Communauté cherche un autre équilibre. La composition libérale à laquelle aboutit finalement la Communauté européenne apparaît dans la mise en œuvre des règles de concurrence du Traité et tient à la convergence des volontés du conseil et de la commission.

Book excerpt: In twenty years, the globalization of trade has led to a change in scale that has upset the balance of power between the players in online containerized maritime transport and the logistics chain passing through European seaports. Three global shipping alliances dominate 90% of online containerized maritime transport, while further integrating port activities. Twelve Asian ports, eight of which are Chinese, are now among the top fifteen in the world. At the same time, Chinese interests, supported by public authorities and resources, are taking control of terminals and port companies in Europe, as part of the geopolitical project of the New Silk Roads. This economic and industrial context is emblematic of the challenges facing European competition law, which has so far accompanied rather than controlled these transformations. European competition rules will have to be mobilized in a global context, alongside the new rules on the control of foreign direct investment. This study takes stock of the new regulatory challenges in this sector of prime importance for the Union.
