This book was released on 2016-02-25 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Book excerpt: Collectively, mankind has never had it so good despite periodic economic crises of which the current sub-prime crisis is merely the latest example. Much of this success is attributable to the increasing efficiency of the world's financial institutions as finance has proved to be one of the most important causal factors in economic performance. In a series of insightful essays, financial and economic historians examine how financial innovations from the seventeenth century to the present have continually challenged established institutional arrangements, forcing change and adaptation by governments, financial intermediaries, and financial markets. Where these have been successful, wealth creation and growth have followed. When they failed, growth slowed and sometimes economic decline has followed. These essays illustrate the difficulties of co-ordinating financial innovations in order to sustain their benefits for the wider economy, a theme that will be of interest to policy makers as well as economic historians.

Book excerpt: Earthen architecture constitutes one of the most diverse forms of cultural heritage and one of the most challenging to preserve. It dates from all periods and is found on all continents but is particularly prevalent in Africa, where it has been a building tradition for centuries. Sites range from ancestral cities in Mali to the palaces of Abomey in Benin, from monuments and mosques in Iran and Buddhist temples on the Silk Road to Spanish missions in California. This volume's sixty-four papers address such themes as earthen architecture in Mali, the conservation of living sites, local knowledge systems and intangible aspects, seismic and other natural forces, the conservation and management of archaeological sites, research advances, and training.

The essays range from sophisticated treatments of historical and hence philosophical variations in concept and practice to detailed practical advice on self-education. Essays show a particular concern for the challenges of courtroom discourse when the parties not only use different languages but operate from different cultural and legal traditions.

Book excerpt: A review of the original French edition of this book in the American Journal of Sociology hailed it as "the most finished product yet to emerge from the new (Marxist) school of French urban sociology... The aim of the book is nothing less than to reconceptualize the field of urban sociology. It is carried out in two stages: a critique of the literature of urban sociology (and urbanization) and an attempt to lay the Marxist bases for a reconstructed urban sociology." The problems facing the world's cities, whether problems of development or of decay, cannot be solved until they have been diagnosed. The race riots in Detroit, the shantytowns of Paris, the financial crisis of New York must not be seen in isolation. The mushrooming cities of the third world, demolition and urban sprawl at home are located in a network of economics, social welfare and power politics, and the decisions we are called upon to make elude us in a fog of ideology. This brilliant exposition of the function of the city in social, economic and symbolic terms illuminates the creation and structuring of space by action administrative, productive and more immediately human. The interaction of environment and life-style, the complex of market forces and state policy against a background of traditional social practice is scrutinized with the aim of establishing concepts and research methods that will enable us to come to grips with the cities themselves and the way in which we view them. Castells draws on urban renewal in Paris, the English New Towns, the American megalopolis for concrete data in his empirical and theoretical investigation. In this English edition, a new Part V has been added on urban development in America. The chapters on the pobladores in Chile and the struggle of the FRAP in Quebec have been greatly extended and an Afterword traces the development of research in the past five years. -- Amazon.com.

While statutes are drafted in a manner that aspires to have both versions mirror one another, in practice, dual versions are often open for different interpretations, a situation that can prove extremely problematic."--pub. desc.
