Book excerpt: It is a truism to state that since the end of the Cold War there has been unprecedented activity in the United Nations Security Council. These days the Council adopts around a hundred resolutions every year, and acts in the most diverse fields. It is true that its actions fall within the framework of Chapter VII of the United Nations Charter, but they are the expression of a considerable extension of the concept of international security. This dynamism is explained, inside the Council, by the fact that since the Gulf War the Council has no longer been stymied by the casting of a veto, and outside the Council, by the increased number of armed conflicts, especially in Africa (Mozambique, Somalia, Liberia and Angola) and in Eastern Europe. The Council has never until now been called upon so often to send peace-keeping forces to so many parts of the world. These are the thoughts which induced the Curatorium to organize a workshop to evaluate the scale and significance of this phenomenon. This volume is the outcome of the workshop. First of all, it examines the development of the powers of the Security Council; secondly, the development of the areas in which it acts; and finally it determines the place of the Security Council within the United Nations system.

Available in PDF, EPUB and Kindle. Book excerpt: This work aims to fill a gap in the existing legal literature by presenting a compact, concise but nevertheless panoramic view of the law of the United Nations. Today the organisation is at the centre of all multilateral international relations and impossible to avoid. And of course the UN Charter is a foundational document without which modern international law cannot be properly understood. In spite of its importance, this pre-eminent world political organisation is poorly understood by the general public, and the extent and variety of its activities is not widely appreciated. Even lawyers generally possess insufficient knowledge of the way its legal institutions operate. Assessments of the organisation and judgements about its achievements are consequently frequently distorted. This work is aimed especially at remedying these deficiencies in public and legal understanding, but also at presenting the organisation as a coherent system of values and integrated action. Thus the book presents an overarching view of the significance of the UN organisation in general, the history of its origins in the League of Nations, the aims and principles of the Charter, governmental agencies, members of the Organisation, the non-use of violence and collective security, the peaceful settlement of disputes, and the question of amendments to the Charter. This work will be suitable for students of law and international relations, as well as scholars and those interested in the work and organisation of the United Nations.

Available in PDF, EPUB and Kindle. Book excerpt: Experience and research have long shown an intrinsic link between human rights, conflict and development. This interdependence between different areas, doctrines, and disciplines calls for a genuinely coherent, holistic approach in International Affairs. With the challenges the work for the protection and respect of humanity encounters, this book intends to bring together articles and ideas that indicate the complexity of such an endeavor. The chapters, written by academics and practitioners encompass snapshots of crucial development lines as well as conceptual ideas and frameworks. In doing so the book provides insight to the principal understanding that peace efforts, encapsulating human rights, conflict management and development, can only be sustained and flourish as long as conflicting parties have at least a minimal consensus and will to settle their differences peacefully. As a Liber Amicorum for Joseph Voyame the book honors the determination for humanity and respect for human dignity and peaceful mitigation of conflict which marked his life and work.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the hard legal core, if any, of the “Responsibility to Protect (R2P)” concept with regard to the commitment to take collective action through the UN Security Council. It addresses the question of whether public international law establishes a duty on the part of the individual Security Council members to collectively take the necessary action to prevent atrocities (genocide, crimes against humanity, war crimes and ethnic cleansing). To this end, it offers an interpretation of provisions in multilateral conventions, such as the undertaking to prevent genocide in Article 1 of the Genocide Convention and the undertaking to ensure respect for the Geneva Conventions in common Article 1 of the 1949 Geneva Conventions, analyses the UN Charter framework for Security Council action, and explores whether the recognition of the international responsibility to protect has prompted the emergence of a new norm for general international law.

Available in PDF, EPUB and Kindle. Book excerpt: The Procedure of the UN Security Council is the definitive book of its kind and has been widely used by UN practitioners and scholars for nearly 40 years. This comprehensively revised edition contains over 450 pages of new material documenting the extensive and rapid innovations in the Council's procedures of the past two decades. A one-stop handbook and guide, with meticulous referencing, this book has served diplomats, UN staff and scholars alike in providing unique insight into the inside workings of the world's preeminent body for the maintenance of international peace and security. Thoroughly grounded in the history and politics of the Council, it brings to life the ways the Council has responded through its working methods to a changing world. The book explains the Council's role in its wider UN Charter context and examines its relations with other UN organs and with its own subsidiary bodies. This includes the remarkable expansion in UN peacekeeping, peacebuilding and political missions, sanctions and counter-terrorism bodies, and international legal tribunals. It contains detailed analysis of voting and decision-taking by the Council, as well as the place, format, and conduct of meetings. It also seeks to illuminate the personalities behind the Council's work - ranging from the diplomats who sit on the Council itself to the UN Secretary-General, and those outside the Council affected by its decisions. It concludes with reflections on the improvements that have made to the Council's procedures over many decades, and the scope for further reform.

Whilst rooted in public international law, it also approaches the question from different angles, including its historical evolution and its sociological environment. The competences and practice of the UN and of regional organizations in the maintenance of peace are examined before the focus is shifted to the inter-State level, the main non-use of force rule and its claimed or recognized exceptions. Robert Kolb analyzes each of these rules separately, before concluding with insightful reflections on the current state-of-play and considerations for the future of this branch of the law.

The second part of the book examines the activity of regional organizations both in their own right as well as their interaction with the UN. The volume concludes with a discussion of whether, to what extent and how the fight against terrorism has encroached upon fundamental rules of international law such as the international protection of human rights or the use of force among states. The volume is the latest in a series drawing on the presentations of high ranking scholars, diplomats and representatives of international organizations. The result is a stimulating and thought-provoking book which will be of interest to researchers and policy-makers alike.

Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the transformation of the international legal system into a new world order. Looking at concepts and principles, processes and emerging problems, it examines the impact of global forces on international law. In so doing, it identifies a unified set of legal rules and processes from the great variety of state practice and jurisprudence. The work develops a new framework to examine the key elements of the global legal system, termed the 'four pillars of global law': verticalization, legality, integration and collective guarantees. The study provides an in-depth analysis of the differences between traditional international law and the new principles and processes along which the universal society and world power are organized and how this is related to domestic power. The book addresses important changes in key legal issues; it reconstructs a complex legal framework, and the emergence of a new international order that has still not been studied in depth, providing a compass that will prove a useful resource for students, researchers and policy makers within the field of law and with an interest in international relations.

Available in PDF, EPUB and Kindle. Book excerpt: Since the third edition of this commentary on the Charter of the United Nations was published in 2012, the text of the Charter has not changed DL but the world has. Central pillars of the international order enshrined in the UN Charter are facing serious challenges, notably the prohibition of the use of force. Human rights, too, have come under increasing pressure, now also from contemporary information technology. Global warming poses fundamental challenges for the world community as a whole in its effort to stabilize global ecosystems. Fully updated, the commentary takes up these and other developments. It features new chapters on Climate Change and the Human Rights Council. The commentary remains the authoritative, article-by-article account of the legislative history, interpretation, and practical application of each and every Charter provision. Written by a team of distinguished scholars and practitioners, this book combines academic research with the insights of practice. It is an indispensable tool of reference for all those interested in the United Nations and its legal significance for the world community. The Commentary will be crucial in combining solid legal foundations with new directions for the development of international law and the United Nations in the twenty-first century
