Sa structure et son fonctionnement fait, depuis un certain temps, l'objet des critiques de divers ordres. A ce sujet, plusieurs réflexions ont été faites à l'issue desquelles des propositions sont présentées en vue de réformer ledit organe pour l'adapter aux nouvelles exigence de la scène internationale. Cependant, il n'en demeure pas moins vrai que ce processus de réforme ne sera pas facile à cause des divergences autour de la question. Néanmoins, nous pensons avec la moindre certitude possible que ces nouvelles exigences s'imposeront et l'on finira un jour à procéder à la réforme du Conseil de Sécurité, comme ce fut le cas en 1963. En cette année, l'augmentation du nombre des membres au sein des Nations Unies a eu comme conséquence la révision de la composition du Conseil. Avant 1963, ce dernier comptait 11 membres soit 5 permanents et 6 non permanents. Mais après cette réforme, il en compte à ce jour 15 dont 5 permanents et 10 non permanents.

La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
