Although the notion of sovereignty has been central in the contentious debates triggered by the recent crises in the European Union, it remains strikingly under-researched in political science. This book bridges this gap by providing both theoretical reflections and empirical analyses of today’s conflicts of sovereignty in the EU. More particularly, it investigates conflicts between four types of sovereignty. First, national sovereignty referring to the autonomy of the Westphalian Nation-State to rule on a territory delimited by borders; second, the supranational sovereignty acquired by the EU in a fragmentary fashion in a number of scattered internal and external policy fields; third, parliamentary sovereignty understood as the autonomy of parliaments (at the regional, national and European levels) to take part in the decision making process and control the executive in the name of the principles of election and representation; fourth, popular sovereignty whereby the body politic confers legitimacy to decision makers in a democratic system. Through an analysis of the various crises (rule of law, Brexit, migration, Eurozone crisis), the chapters look at how sovereignty is framed and contested by different types of actors, and how the strengthening or the weakening of certain types of sovereignty contribute to shape preferences regarding policies and governance structures in the multi-level EU. The chapters in this book were originally published as a special issue of the Journal of European Integration.

In most international comparisons, France typifies the "Napoleonic" model for policing, one featuring administrative and political centralization, a strong hierarchical structure, distance from local communities, and a high priority on political policing. France has undergone a process of pluralization in the last 30 years. French administrative and political decentralization has reemphasized the role of local authorities in public security policies; the private security industry has grown significantly; and new kinds of governing models (based on arrangements such as contracts for service provision) have emerged. In addition, during this period, police organizations have been driven toward central government control through the imposition of performance indicators, and a top-down decision was made to integrate the national gendarmerie into the Ministry of Interior. Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. Book excerpt: Border security has been high on public-policy agendas in Europe and North America since the September 11, 2001 attacks on the World Trade Centre in New York City and on the headquarters of the American military in Washington DC. Governments are now confronted with managing secure borders, a policy objective that in this era of increased free trade and globalization must compete with intense cross-border flows of people and goods. Border-security policies must enable security personnel to identify, or filter out, dangerous individuals and substances from among the millions of travelers and tons of goods that cross borders daily, particularly in large cross-border urban regions. This book addresses this gap between security needs and an understanding of borders and borderlands. Specifically, the chapters in this volume ask policy-makers to recognize that two fundamental elements define borders and borderlands: first, human activities (the agency and agent power of individual ties and forces spanning a border), and second, the broader social processes that frame individual action, such as market forces, government activities (law, regulations, and policies), and the regional culture and politics of a borderland. Borders emerge as the historically and geographically variable expression of human ties exercised within social structures of varying force and influence, and it is the interplay and interdependence between people's incentives to act and the surrounding structures (i.e. constructed social processes that contain and constrain individual action) that determine the effectiveness of border security policies. This book argues that the nature of borders is to be porous, which is a problem for security policy makers. It shows that when for economic, cultural, or political reasons human activities increase across a border and borderland, governments need to increase cooperation and collaboration with regard to security policies, if only to avoid implementing mismatched security policies.

The Schengen area, established in 1985 and today encompassing twenty-nine European countries, allows people, goods, and capital to cross borders without restraint. Schengen transformed European life, advancing both a democratic project of transnational citizenship and a neoliberal project of international free trade. But the right of free movement always excluded non-Europeans, especially migrants of color from former colonies of the Schengen states. In Europe without Borders, Isaac Stanley-Becker explores the contested creation of free movement in Schengen, from treatymaking at European summits and disputes in international courts to the street protests of undocumented immigrants who claimed free movement as a human right. Schengen laid the groundwork for the making of a single market and the founding of the European Union. Yet its emergence is one of the great untold stories of modern European history, one hidden in archives long embargoed. Stanley-Becker is among the first to have access to records of the treatymaking—such as letters between France’s François Mitterrand and West Germany’s Helmut Kohl—and Europe without Borders offers a pathbreaking account of Schengen’s creation. Stanley-Becker argues that Schengen gave a humanist cast to a market paradigm; but even in pairing the border crossing of human beings with the principles of free-market exchange, this vision of free movement was hedged by alarm about foreign migrants. Meanwhile, these migrants—the sans-papiers—saw in the promise of a borderless Europe only a neocolonial enterprise.

It gives a complex picture of individual journeys of migrant women, and in a radical departure from the miserabilist or culturalist approach through which women are usually viewed, and instead argues for a politically and socially aware feminism that is attuned to what border-obsessed migration policies actually do to women. The book depicts the journey of women as they experience brutal separations and make heart-wrenching decisions, but also as they make acquaintances and find new opportunities. The first-person accounts collected here demonstrate that the reasons behind these women's decision to leave are anything but simple and linear: they combine various forms of persecution and oppression with a desire for autonomy.The book further explores the daily lives of women in reception centres as they wait for a Europe that rejects them to acknowledge their presence. At the same time, this study shows that these women are taking charge of their own destinies and journeys. This accordingly puts the space of everyday life front and centre. Such a space acts as an impediment to these women's journeys: it generates a "moralscape" of waiting, which plays a key role in these women's daily lives. However, it can also help these women gain greater autonomy, thus empowering them. Camille Schmoll is Research Director at École des Hautes Études en Sciences Sociales (EHESS), Fellow of the Institut Convergences Migrations, and a member of the Géographie-cités research centre, France. A feminist political geographer, she is especially interested in gender and migration issues, critical migration studies, and reflexivity within migration scholarship. Her work explores migration from an ethnographic perspective, with a particular focus on the making of border-places (e.g. islands, cities, neighbourhoods) and the trajectories of migrant women. She was Editor-in-Chief of the peer-reviewed journal Revue Européenne des Migrations Internationales from 2019 to 2022, and has authored, co-authored and co-edited several books in French, Italian and English
