L’acte est soigneusement réglementé par un droit très spécial, dont la raison d’être est de préserver les intérêts des créateurs en situation de faiblesse économique face à leur cocontractant. Le parti est pris d’encadrer strictement la formation du contrat et de brider le jeu parfois cruel de la liberté contractuelle. Le contrat d’auteur, si justement faconné par le législateur, a perdu en contrepartie de sa capacité à engendrer l’avenir. Il n’est pas un véritable acte de prévision, « un temps voulu », mais un préalable contraignant sans lequel l’exploitation d’une œuvre de l’esprit est impossible, « un temps subi ». Dans l’univers moderne des pratiques artistiques, l’anticipation a pourtant pris de l’importance. L’évolution rapide des mœurs techniques, la rapidité accrue des échanges, l’élargissement des frontières d’exploitation, la responsabilisation plus grande des auteurs, parfois plus au fait de leurs droits qu’ils ne l’étaient il y a cinquante ans, la multiplication des intermédiaires dans la chaîne de diffusion des œuvres, invitent plus que jamais l’exploitant à devancer l’avenir par le jeu du contrat. Notre thèse entend concilier le fondement protecteur de la discipline du droit d’auteur avec le désir d’anticiper qui anime l’exploitant. Elle expose, d’une part, les imperfections de l’équilibre des intérêts actuel et propose, d’autre part, des directions à emprunter pour construire les bases d’un équilibre meilleur. La thèse encourage la construction d’un droit d’auteur efficient et pragmatique, prêt à observer plus concrètement l’objectif de protection et en accepter une considération mesurée, adéquate aux « réalités vivantes » de notre temps.
