Si les principes fondateurs du droit pénal moderne que sont le principe de légalité et le principe d’interprétation stricte semblent interdire d’envisager le concept sous un angle autre que formel, la dérive vers un droit pénal du danger révèle les faiblesses des garanties traditionnelles comme l’impuissance des outils théoriques classiques pour analyser les évolutions d'une matière pénale mouvante et aux frontières de plus en plus troublées. Il semble alors indispensable de replacer la question de la finalité du droit pénal au cœur de la réflexion juridique. L’adoption d’une définition matérielle du bien juridique protégé, non par la détermination illusoire d’une liste de biens a priori dignes de protection pénale mais par la reconnaissance de l’indéniable contenu axiologique de la loi pénale, offre, outre la perspective d’une analyse critique du droit positif, un cadre théorique nouveau permettant de mieux comprendre ses enjeux et ses évolutions. Repensée autour de la distinction fondamentale entre injuste et imputation de l’injuste, l’infraction retrouve un contenu substantiel et des critères de distinction qui expliquent ou éclairent de nombreuses solutions du droit positif. La qualification de l’injuste, soumise à une appréciation axiologique objective, se trouve ainsi dissociée de la question son imputation, ce qui permet de réaffirmer l’exigence d’une responsabilité subjective du sujet actif tout en préservant et en encadrant les prérogatives du sujet passif.

L'adoption d'une définition matérielle du bien juridique protégé, non par la détermination illusoire d'une liste de biens a priori dignes de protection pénale mais par la reconnaissance de l'indéniable contenu axiologique de la loi pénale, offre, outre la perspective d'une analyse critique du droit positif, un cadre théorique nouveau permettant de mieux comprendre ses enjeux et ses évolutions. Sans renoncer aux garanties essentielles du principe de légalité ni faire de la responsabilité pénale une responsabilité morale, l'infraction se trouve repensée autour de la distinction fondamentale entre injuste (comportement typique antijuridique) et imputation de l'injuste. La qualification de l'injuste, soumise à une appréciation axiologique objective, est ainsi dissociée de la question de son imputation. ce qui permet de réaffirmer l'exigence de responsabilité subjective du sujet actif tout en préservant et en encadrant les prérogatives du sujet passif.
